Beat the Star recruitment terms

1.         Application eligibility requirements
To be eligible to apply to participate in the programme, ‘Beat the Star’ (the “programme”), you must meet the following eligibility criteria:
 
(a)     You must be a resident of the United Kingdom; and
(b)     You must be aged eighteen (18) years or over; and
(c)     You must not be employed, and have not been previously employed or engaged by Diverse Production/Gallowgate Production (the “Production Company”) or the ITV Plc group of companies and you must not be a live-in partner or immediate relative (i.e. mother, son, daughter, brother or sister) of an employee at the Production Company or the ITV Plc group of companies or any of their subsidiaries and/or agencies associated with this competition; and
(d)     You must be in good general health and fitness, and take regular exercise.
 
2.         Application process:
Eligible applicants may apply to participate in the programme, by email only.
 
You may request an application form by sending an email to: applicants@diverse.tv stating that you wish to participate in the programme, and providing the following details: name, age, postal address, occupation, telephone number and email address.
 
You are required to provide a valid email address to receive an application form. Failure to provide a valid email address will render your request invalid.
 
The Production Company endeavours to email an application form to each person who has correctly followed the instructions and who has requested an application form by email no later than 5:00 p.m. on 17 November 2008.
 
There is no charge when requesting an application form via email, although internet service provider’s fees may apply.
 
There is no restriction on the number of times you may request an application form.
 
Completed application forms must then be returned as indicated below. Application forms must be completed fully and honestly, providing all the required information.
 
Any information and data which is provided by you when you apply to participate in the programme will be held and used by the Production Company and their sub-contractors in accordance with section 10 of the application form.
 
Applying to participate in the programme signifies acceptance of these terms and conditions and the terms and conditions on the application form.
 
3.         Returning the Application Form
Eligible applicants wishing to participate in the programme are required to return the signed application form by email or post, correctly filled in with the relevant required information no later than the application closing date and time, on 19 November 2008 at 5:00 p.m.
 
Application forms signed and correctly filled in with the required information may be sent by email to: applicants@diverse.tv, or via post to: Beat the Star Applications, Diverse Production Ltd., 6-12 Gorleston Street, London W14 8XS.
 
There is no charge when emailing or posting a completed application form, except internet service provider’s fees and postage as applicable.
 
Receipt is deemed upon arrival at the email or postal address as indicated above. It is the responsibility of the person submitting an application form to ensure that the information submitted is correct and valid at the time of application, and to ensure that the fully completed application form arrives at the designated address no later than the closing date and time as specified.
 
The Production Company cannot acknowledge receipt of application forms or return any application forms and/or photographs.
 
There is no restriction on the number of times you may apply to participate in the programme.
 
Application forms which are sent to and/or received by the Production Company after the closing date and time for receipt of applications, or which are incorrect, false, misleading, incomplete, incomprehensible, incorrectly addressed, lost in transit, with insufficient postage, or not received at the designated address are void and will not be considered. The Production Company reserves the right in its sole discretion to invalidate any application form received. The Production Company cannot accept responsibility for any application forms which are not received by the closing date and time.
 
Applications will only be accepted if they contain solely the work of the applicant and they include no third party images or other third party content. Applicants warrant that they will not submit any material which in any way infringes the rights of a third party, or which infringes any applicable laws.
 
By completing and returning the application form, you warrant that you are eligible to apply, that the information provided is neither false nor misleading in any way, and you agree to be contacted by the Production Company, at the Production Company’s discretion.
 
The Production Company reserves the right in its sole discretion to contact any applicant on the phone number and/or email address as indicated on their application form for participation in a future episode of the programme. The Production Company does not guarantee that all applicants will be considered and/or contacted.
 
Successful applicants will be contacted no later than 28 November 2008 to participate in the programme.
 
4.         Selection/audition process:
The Production Company will select a number of applicants to attend an audition to be in the programme. The decision of the Production Company is final.
 
Selected applicants will be contacted on the phone number and/or email address they provided at the time they applied. If they cannot be contacted, or they are not eligible and/or do not comply with any of these terms and conditions as specified, then the Production Company reserves the right to select the next eligible applicant.
 
It is the responsibility of the applicant to ensure that they are available at the times as specified to attend the location of the audition and/or filming of the programme as applicable. It is the responsibility of the applicant to make their own way to the specified location, unless otherwise stated.
 
If selected to participate in the programme, you agree to be available to attend at an address to be provided, and to appear on the programme on the agreed date and time in the Production Company’s discretion. You will be required to bring proof of age and eligibility.You will also be required to provide proof of address and UK residency. It is the responsibility of an applicant to comply with any directions and/or instructions given to them, including, without limitation, in regard to conformity with the Ofcom Broadcasting Code, health and safety instructions and all relevant laws, rules and regulations. Failure to provide valid and current proof of age and/or eligibility or to comply with any directions or regulations will result in that applicant no longer being permitted to proceed further in the programme and/or competition.
 
Selected applicants must agree to be filmed for the programme by signing a release form which shall be provided by the Production Company. Failure to agree to being filmed as specified will result in that applicant not being able to participate further and forfeiture of all rights as a participant in the programme. The decision of the Production Company is final and no correspondence will be entered into.
 
Neither the Production Company nor ITV is liable to refund any costs or expenses incurred in applying to participate in the programme, or in participating in the programme, including but not limited to the cost of calls made, postage, internet access fees, travelling expenses, transportation, accommodation, meals, drinks, insurance, taxes and costs unless otherwise provided for.
 
5.         General rules
The Production Company, ITV and their sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, software provider or otherwise which may result in any emails or application forms not being properly received or recorded.
 
The Production Company and/or ITV cannot promise that the system and/or service will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The system and/or service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of the Production Company or ITV. Neither the Production Company nor ITV will be liable to you or to any other person in the event that all or any part of the system and/or service is discontinued, modified or changed in any way.
 
Neither the Production Company nor ITV is responsible for any irregularities, industrial action, delay or other disruption in the postal service, and will not be held liable in any such event.
 
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
 
6.         Queries/Complaints
If you have a query about your application, you may register your query with the Production Company who can be contacted by email at applicants@diverse.tv. You will need to give the following information:
 
a) Your Name
b) Your email address or mailing address
c) If possible, the IP number of your computer and your internet service provider where relevant
d) The date(s) and time(s) when you experienced problems
e) The nature of the problem you have been experiencing
f) A contact telephone number you can be reached on if necessary
