APPLICATION TERMS & CONDITIONS FOR COLEEN’S REAL WOMEN
A. APPLICATION PROCESS
1. If you wish to apply to become one of Coleen’s ‘Real Women’ to be filmed for a television programme (‘Programme’) produced by Endemol UK Plc t/a Initial (‘Endemol’) to be transmitted on ITV, you may download an application form from the website at www.itv.com/coleen (“Website”). Once you have filled out the application form, you may email the completed form and photographs to: realwomen@endemoluk.com (“Email Address”), or alternatively, please send the application form by post addressed to Coleen’s Real Women, Endemol UK Plc, Shepherds Building Central, Shepherds Bush, London W14 0EE (“Postal Address”).
2. To participate in the Programme, you must be aged 18 years old or over, and you must have your main place of residence in the United Kingdom or Republic of Ireland, and you must not be an employee of ITV or Endemol.
3. The opening date to email or post the completed application forms to participate in the Programme is Thursday 28th February 2008 from 2pm. The closing date and time for receipt of the completed application forms is as specified on the Website.
4. There will be no charge for submitting your application by email. You will be responsible for paying the postage charges should you decide to submit your application by post.
5. If you send your application by email, you will be sent a response indicating receipt of your application form. If you submit your application by post, you will not be sent an acknowledgement. Due to the large number of applications we receive we will not respond to each application, only those of successful applicants. Coleen and her team will review your application in conjunction with Endemol and shall decide whether they think you are suitable to put forward to castings (‘Casting(s)’).
6. If you are selected for Castings, you will be sent a request by phone to attend a Casting Endemol will use reasonable efforts to arrange a Casting closest to your home city but this cannot be guaranteed.
7. Any and all costs of completing and sending in your application and, if you are selected, any transport costs to and from the Casting (or any further Castings if successful), shall be borne by you and in no circumstances shall ITV or Endemol be liable to refund any such costs to you.
8. Neither Endemol nor ITV can guarantee that your application will be successful and the choice of applicants to proceed to the Casting stage and beyond to be chosen as one of Coleen’s ‘Real Women’ for the Programme will be at Coleen’s (in conjunction with her team and Endemol) final decision. There will be no right of appeal against any decisions taken.
9. You agree that you own all rights in and to any photographs you submit with your application or that you have permission to send the photographs from the person who took the photograph and the person featured in the photographs, and you hereby grant to Endemol a non exclusive irrevocable licence to use and permit the use of all photographs submitted with your application for the purpose of the Casting process and at the discretion of Endemol and ITV, for inclusion in the Programme in all media now known or hereafter invented, worldwide in perpetuity. You agree that any photographs supplied with your application and your application form will not be returned to you.
10. Any information and data which is provided by you when you apply to participate in the Programme will be held and used by Endemol, and their sub-contractors in order to administer the competition in accordance with the provisions of Endemol’s data protection and privacy policy below.
11. You acknowledge and agree that if you are successful and are chosen to attend a Casting, or other round of further castings, that you may be filmed by Endemol and your appearance may be included in the Programme.
12. ITV, Endemol and their sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any computer network, system, server, provider or otherwise or any postal service failures which may result in any application not being properly received.
13. ITV, Endemol and their sub-contractors cannot promise that the Website will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of ITV, Endemol and their sub-contractors. ITV, Endemol and their sub-contractors will not be liable to you or to any other person in the event that all or any part of the Website is discontinued, modified or changed in any way.
14. Nothing in these terms and conditions restrict your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
B. QUERIES/COMPLAINTS
If you have a query about the application process, you may register your query with the ITV duty office who can be contacted by phone on 0844 88 14150, or by email at dutyoffice@itv.com. You will need to give the following information:
1. Your Name
2. Your email address
3. The date(s) and time(s) at which you experienced problems in submitting your application
4. A contact telephone number you can be reached on, if necessary

C. PRIVACY POLICY AND DATA PROTECTION
Your privacy is very important to Endemol. Please read this Privacy and Data Protection Policy to learn about the ways in which we use and protect your personal information.
General Principles
By accessing your application form and submitting your application form to the Email Address or Postal Address you are agreeing to be legally bound by the Terms and Conditions and this Privacy and Data Protection Policy. You should therefore also read the Terms and Conditions before making your application. By accepting this Privacy and Data Protection Policy you expressly consent to our use and disclosure of your personal information in the manner prescribed in this Privacy and Data Protection Policy. If you object to this use and disclosure please do not register with us or please inform us that you no longer wish to be registered with us using the contact information set out below.
The data controller of data sent to the Email Address and Postal Address is Endemol.
Use of Data
If you choose to complete and send your application form to the Email Address or Postal Address, we will collect personally identifiable information from you including your name, age, address, email address, profession, financial information and other personal and sensitive information contained in the application form. This data is kept secure and will only be used for the purposes set out in this Privacy and Data Protection Policy and the Terms and Conditions.
The data controller will collect, hold and use your information together with other information for the purposes for which you provided the information including in relation to (a) the selection of potential participants for Coleen’s modelling campaign and as contributors to a series of television programmes that we produce connected with such campaign provisionally entitled “Coleen’s Real Women” (‘the Programme’), (b) the development and production of the Programme, (c) the development and production of other programmes or material produced by Endemol or any of its parent or subsidiary companies and/or (d) where required by operation of law. We may disclose your information to our third party contractors, agents and distributors as reasonably required to enable us to fulfil the purposes set out herein. We may keep your information for a reasonable period.
You may review and update your personal information submitted to us. If you wish to no longer be registered as an applicant for the Programme or be contacted by us or should you no longer wish us to hold data about you, you can opt out by simply contacting us as indicated below.
Disclosure of your information
By providing your personal information to us, you consent to (a) our processing your sensitive personal data for the purposes set out in this Privacy and Data Protection Policy; and (b) our transferring your information to countries which do not provide the same level of data protection as the UK if necessary for the above purposes. If we do make such a transfer we will put a contract in place to ensure your information is protected.
We will take every precaution to protect your data and the following principles will apply when we process your personal data:
- Your data is only processed with your knowledge
- Only data that we actually need is collected and processed
- Your data is only seen by those who need it to do their jobs
- Your data is retained only for as long as it is required
- Your data is accurate
- Decisions affecting you are made on the basis of reliable and up-to-date data
- Your data is protected from unauthorised or accidental disclosure
- You will be provided with a copy of data we hold on you, on request
Cancelling your application
Upon your written request, we will remove all of your personal information from our active databases and paper files. To make this request, please contact us at the address below. Such information will be removed as soon as reasonably possible in accordance with our deactivation policy and applicable law. You acknowledge that some of your information may never completely be removed from our databases due to technical and legal constraints, including stored "back up" systems.
You have a right to ask for a copy of your information (for which we may charge a small fee) and to ask us to correct any inaccuracies in your personal information (which is free). To make sure we follow your instructions correctly and to improve our service to you through training of our staff, we may monitor or record telephone calls.
