Entrants’ eligibility
A teacher in a school in one of the ITV News regions participating in this competition (a “participating region”) may, on behalf of a school in a participating region, enter no more than 2 teams per school into the competition in teams of up to 3 students per team from school-years 8, 9, 10 or 11 by submitting the relevant entry information. The entry information includes providing the requisite information as indicated, from such students.
Neither the teacher nor the students may be related to employees of the Promoter, companies within the ITV group of companies and any of their subsidiaries and/or agencies associated with this competition. Any such entrants are ineligible and such entries will be invalid. Proof of eligibility and age may be required.
Method of entry:
A teacher on behalf of a school in a participating region may go online at http://www.b-live.com (the “website”) to download an entry form and application form. Each school may submit no more than two entries. The teacher, in conjunction with the students who will take part in the competition on behalf of the school, must complete and sign where relevant, the application form and entry form as downloaded from the website.
The teacher is required to complete the application form and the students are required to complete the entry form.
In addition to the required signatures and contact information, entries must include an outline of a local news story idea, based on the school’s local region, which would be suitable for broadcast on the ITV regional news. The entry must describe how the local news story could be aired and must have relevance to the local community.
The completed and signed entry form and application form may then be sent in by the teacher by email, post or fax. Information sent in when entering this competition cannot be returned. Neither the Promoter nor the prize provider will have any responsibility to comment or give a professional opinion on the ideas or other content provided in an entry or to respond to the entrants in any way.
Failure to provide the required information will render that entry invalid, and such entry will not be entered into the competition. Entries over the maximum number of entries, or entries made or received by the Promoter after the closing date and time will not be entered into the competition. Entries which are missing the required signature(s) or which are otherwise incomplete, incomprehensible, false, misleading, incorrectly addressed, lost in transit, with insufficient postage, or not received by the Promoter are void and will not be entered into the competition. Neither the Promoter nor ITV can accept responsibility for any entries which are not received by the closing date and time.
Content submitted when entering this competition will only be accepted if it does not include any third party content, and the entrant warrants that they will not submit any material which in any way infringes the rights of a third party or any applicable laws. Entrants may not submit entries containing any material or content which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. Entrants agree not to advertise or promote third parties' or their own goods or services including by way of the distribution of "spam", or to transfer files which contain viruses or other harmful programs or to provide links to third party websites. Any such submitted content will be deemed inappropriate and will not be accepted.
By entering this competition, entrants grant to the Promoter a worldwide, perpetual, non-exclusive, royalty-free and transferable licence (with the right to sub-license) to use, edit, reproduce, record, modify, adapt, translate, distribute, play, perform, make available, prepare derivative works of and to display their entry by any medium or method whether now known or later developed to be exercised in the Promoter's sole discretion throughout the world for the full term of copyright and other rights and all renewable and extension thereof including, for the avoidance of doubt, the right to register any design rights and/or trademarks. Entrants agree to waive their moral rights in their entries.
Entrants further agree that ITV will own all present and future intellectual property rights and rights in the nature of intellectual property rights existing in or in relation to the works created in taking up the prize during the work experience day, including without limitation in or to any filming. If any such rights vest in the entrants or in those participating in the prize or their agents, whether by operation of law or otherwise, such persons agree to assign to ITV all rights, title and interest (whether legal or beneficial) in such works and shall do all acts and things as may be reasonably required to assign such rights to ITV. All such persons unconditionally and irrevocably waive any and all moral rights they may have either now or in the future in or in relation to the works.
Entrants’ data will be used to administer the promotion and not for marketing purposes except with their consent.
Selecting the winner:
Each entry will be assessed according to the location of the school in each of the following ITV news regions: Anglia, Border, Central, Granada, London, Meridian (east of region), Meridian (west of region), Tyne Tees, Wales, Westcountry, West and Yorkshire.
For each region, a selection panel appointed by ITV will judge each school’s entry or entries based on criteria including without limitation originality, creativity of treatment, relevance to audience and communication skills to determine the school to be the winner of the first prize (the “first prize”), and the runner-up prize (the “runner-up prize”), (together the “prize”). The judges’ decision is final.
The winner of the prize is required to provide a signed parental consent form (as provided by the relevant school) for each student. Failure to provide a parental consent form could result in forfeiture of the prize.
Competition judging date:
Judging will take place during the month of December 2009.
Cost of entry:
There is no charge to enter the competition. However, entries sent via email may incur internet access fees, and sufficient postage must be paid for postal entries. Entries sent in fax may incur telephony charges or other expenses as determined by the bill payer.
Prize:
In each of the ITV regions, the school entry which is deemed the best in that region based on the judges’ selection criteria will be the winner of the first prize. The first prize is for up to 3 students in the winning team, accompanied by a responsible adult (for example, a parent/guardian or teacher) to work with ITV regional news journalist(s) and camera operator for one day only to film a story about their local community together with facilities to enable them to make the film. The film will be based on developing the local news story idea submitted in the winner’s application form and/or entry form. ITV does not guarantee that the winner’s local news story idea will be broadcast on-air and/or in any other media. It is the responsibility of the participants from the relevant school to ensure they are available to take up the first prize on a date in January 2010, as confirmed by the Promoter.
In each of the ITV regions as specified, the school entry which is deemed the next-best entry in that region based on the judges’ selection criteria will be the winner of the runner-up prize. The runner-up prize in each region is a cheque for £100 (one hundred pounds sterling), made payable to the school to be spent on the school’s fundraising project of their choice.
It is the responsibility of each entrant to comply with any directions and/or instructions given to them, including, without limitation, in regard to conformity with the Ofcom Broadcasting Code, signature as proof of any required waiver and/or release, health and safety instructions and all relevant laws, rules and regulations. Failure to comply with any directions and/or instructions may result in forfeiture of the prize.
The prize is subject to the terms and conditions of the prize provider. The Promoter reserves the right to amend any element of the prize. The prize is non-changeable and non-transferable. There is no alternative prize or, where relevant, cash equivalent. For the avoidance of doubt, the prize excludes any additional costs and expenses which may be incurred in taking up the prize including but not limited to travel expenses, transportation, meals, drink, accommodation and any other costs or expenses not included in the prize. To the fullest extent permitted by law, the Promoter and/or the prize provider is not liable for any costs, liabilities, damages or losses incurred by a winner and those participating in the competition on behalf of the winner in taking up a prize.
Prize winners will be notified on or as soon as practicable after 6 January 2010 on the phone number they provided when entering the competition. The Promoter will not amend contact information provided once entry to the competition has been made. Reasonable efforts will be made to contact a winner. Failure to respond and/or provide an address for delivery may result in forfeiture of the prize. If they cannot be contacted or they are unable to comply with these terms and conditions then the Promoter reserves the right to offer the prize to the next best eligible entrant according to the selection criteria. Prize winners acknowledge that they may be required to take part in future promotional, marketing and publicity related to this competition in any media worldwide without notice or without any fee being paid.
