By applying to be in the audience for the Programme, you promise that you are eligible to apply, that the information you provide at the time of applying is correct, up to date, and is not misleading in any way, and you agree to be contacted by ITV and/or the producer of the Programme, at their discretion.

ITV and/or the producer of the Programme reserve the right to allocate tickets to be in the audience of the Programme in their sole and absolute discretion irrespective of whether an application has been made or not.

2.         Cost to apply:
There is no charge when applying via the website, but your internet service provider’s fees may apply when accessing the internet.

3.         Application process:
Eligible applicants may apply to be in the audience for the Programme by completing and submitting the form at www.itv.com/jeremykyle, and providing their full name, address and home phone number, mobile phone number and email address (“Personal Information”).

Any Personal Information and other data which is provided by you when you apply to be in the audience for the Programme will be held and used by ITV and their sub-contractors in order to administer your application for the Programme and may be used for future episodes of the Programme, in accordance with the provisions of ITV’s privacy policy. For ITV’s privacy policy, see www.itv.com/Privacypolicy.

Applications which are false, misleading, incomplete, incomprehensible, lost in transit, or not received at the designated address are void and will not be considered. ITV reserves the right in its sole discretion to invalidate any application received. ITV cannot acknowledge receipt of applications. There is no restriction on the number of times you may apply to be in the audience for the Programme.

Participation in the Programme is subject to health and access restrictions.

By applying to be in the audience of the Programme, the applicant accepts these terms and conditions and consents to being filmed and recorded, and the applicant grants ITV, its successors and assigns any and all rights of whatever kind to use, and to permit others to use, all or any part of recordings of any type made of the applicant’s appearance on the Programme in any and all media now known or hereafter devised or invented and by any means throughout the world in perpetuity, and by means of publicity and promotion relating to the Programme.

ITV and/or the producer of the Programme reserve the right to contact any applicant on the phone number they provided when applying to be in the audience for the Programme. Where possible, a message will be left for the applicant and a phone number in Manchester will be provided for the applicant to return the call. Where no message facility is available, one further attempt will be made to contact the applicant on the phone number they provided. If they cannot be contacted, or they are not eligible and/or do not comply with any of these terms and conditions as specified, then ITV and/or the producer of the Programme reserves the right to select the next eligible applicant. ITV does not guarantee that all applicants will be considered and/or contacted, nor does ITV represent, undertake or warrant that it will broadcast any episode of the Programme which may or may not include an applicant.

Neither ITV nor the producer of the Programme is liable to refund any costs or expenses incurred in applying to be in the audience for the Programme, including but not limited to the cost of calls made, internet access fees, travelling expenses, transportation, accommodation, meals, drinks, insurance, taxes and costs.

4.         Audience ticket allocation and attending the studio:
ITV and/or the producer of the Programme will contact an eligible applicant to confirm a date and time for them to be in the audience during the filming for the Programme.

Either a priority or a non-priority audience ticket (hereinafter known as the ‘audience ticket’ in these terms and conditions) will be made available to an eligible applicant, allocated in the discretion of ITV and/or the producer of the Programme.

Each applicant allocated an audience ticket agrees to be available to attend at an address in Manchester (to be provided) and to appear in the audience for the Programme and to being filmed during the Programme on the agreed date and time in ITV’s discretion.

The following conditions apply to each applicant’s entry to the studio to be in the audience for the Programme:
·       ITV reserves the right to refuse admission to the studio.
·       The audience ticket is non-transferable and may not be sold.
·       Photographic ID is required.
·       Mobile phones, cameras and all electronic equipment are strictly banned from the studio and will be removed by security.
·       Applicants will be informed of other applicable conditions of entry on receipt of the audience ticket.

If an applicant is subsequently unable to attend the studio on the agreed date and time as specified on their audience ticket, she/he may be required to re-apply for an audience ticket for the Programme.

Applicants acknowledge that it is necessary for ITV to allocate more audience tickets than there are seats, in order to compensate for those applicants who do not turn up at the studio as agreed, and to ensure that there is a full audience. As a result, on the day of filming, there is a first-come, first-served policy for non-priority audience ticket holders. An applicant with a non-priority audience ticket may therefore be turned away if all the available seats in the studio audience are taken. In such event, applicants holding non-priority audience tickets may be offered priority audience tickets to attend a future recording.

Applicants acknowledge that ITV and/or the producer of the Programme reserve the right to vary the date and time for the applicant to be in the audience during the Programme. The filming schedule is subject to changes and to cancellation at short notice. In the event of schedule changes or where the Programme is cancelled, ITV will not reimburse any travel or accommodation costs or other expenses or costs incurred in connection with an applicant attending the studio to be in the Programme, or otherwise compensate such applicant.

It is the responsibility of an applicant to comply with any directions and/or instructions given to them, including, without limitation, in regard to conformity with the Ofcom Broadcasting Code, health and safety instructions and all relevant laws, rules and regulations. Failure to agree to being filmed as specified or to comply with any directions or regulations will result in that applicant not being able to participate further and forfeiture of all rights as a participant in the Programme. The decision of the producer of the Programme is final and no correspondence will be entered into.

5.         General terms:
ITV and/or the producer of the Programme reserve the right to take down the application form, and/or suspend or close the application process at any time at their sole discretion for any reason including without limitation due to over subscription of audience tickets.

ITV, the producer of the Programme and their sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider, software or otherwise which may result in any applications not being properly received or recorded.

ITV cannot promise that the service/system will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The service/system may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of ITV. ITV will not be liable to you or to any other person in the event that all or any part of the website is discontinued, modified or changed in any way.

Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
