X FACTOR: APPLICATION TERMS & CONDITIONS
 
1. General guidelines
These terms and conditions relate to your application to participate in the television entertainment show entitled “X Factor” (the "Programme") which FremantleMedia Limited (the “Production Company”) proposes but does not undertake to produce for ITV. The information given by you in your application may be used in the Programme should you be selected.
 
You acknowledge and agree to abide by these terms and conditions, and that these terms and conditions may be changed (including without limitation verbally) at any time by the Production Company and that you will be bound by such terms and conditions. The Production Company's decision shall be final.
 
2. Eligibility requirements
To be eligible to apply to participate in the Programme, you must meet the following eligibility criteria:
 
(a)     You must be a resident of the United Kingdom with a valid passport; and
(b)     You must be aged sixteen (16) years or over. Applicants under age 18 must have the permission of their parent or guardian before applying, and must be accompanied by a parent or guardian in the event they are required to participate in the Programme; and
(c)     You must not be employed, and have not been previously employed or engaged by, and must not be a live-in partner or immediate relative (i.e. mother, son, daughter, brother or sister) of an employee at the Production Company or the ITV Plc group of companies, or any of their subsidiaries and/or agencies associated with this competition; and
(d)     You must disclose to the Production Company details of any/all criminal/civil actions pending against you currently and/or served against you and/or any unspent convictions.
 
By applying to participate in the Programme, you promise that you are eligible to apply, that the information you provide at the time of applying is correct, up to date, and is not misleading in any way, and you agree to be contacted by the Production Company, at their discretion.
 
3. Application procedure
Eligible applicants may apply to participate in the Programme, by completing and submitting an application form obtained via one of the following methods:
 
Online:   Download an application form by going to the website at www.itv.com/xfactor and follow the instructions there to provide the required information. There is no charge when applying online, but your internet service provider’s fees may apply when accessing the internet.
 
Post:       Send a stamped self-addressed envelope requesting an application form to:

There is no charge when applying via the post, except for the cost of postage. Receipt is deemed upon arrival at the postal address as indicated above.
 
Phone:   Request an application form by calling 0901 88 11 222, where you will hear instructions to be followed to leave a message with the required information. Each call costs 25p per minute plus a 7p connection charge from a BT landline, and should last no longer than 2 minutes. Calls from other networks may be higher and from mobiles will be considerably more. Callers must obtain the bill payer's permission before calling and please dial carefully. There will be no refunds for the cost of any calls made, or for any misdialled calls.
 
By applying you signify your acceptance of these terms and conditions, and to any applicable terms and conditions provided on the application form.
 
You may not apply via any method not specified here and applications on behalf of another person are void. You must comply with any stated deadline for requesting an application form, and for returning the completed application form. Applications must provide all the required information honestly and truthfully. The Production Company cannot acknowledge receipt of any application or return any application forms, photographs or other submitted content. There is no restriction on the number of times you may apply.
 
Requesting an application form or returning a completed application form which is sent and/or received by the Production Company after the deadline where stated, or which is false, misleading, incomplete, inaudible, incomprehensible, incorrectly addressed, lost in transit, with insufficient postage, or is not received is invalid and will not be considered. The Production Company reserves the right in its sole discretion to invalidate any application received. The Production Company cannot accept responsibility for any application which is not received by the stated deadline.
 
The Production Company and/or ITV will only pass an applicant’s data to third parties for marketing purposes if that applicant has asked to receive marketing information from those third parties. Any information and other data which is provided by you when you apply will be held and used by the Production Company, ITV and their sub-contractors in order to administer your application. All submitted material in your application are considered as “Submissions” (as defined under the Terms of Use at www.itv.com/terms) and are subject to such Terms of Use.
 
4. Selection procedure
The Production Company reserves the right to contact any applicant on the phone number and/or email address as indicated in their application. The Production Company does not guarantee that all applicants will be considered and/or contacted. If an applicant cannot be contacted, or is not eligible and/or does not comply with these terms and conditions as specified, then the Production Company reserves the right to select the next eligible applicant. The decision of the Production Company is final.
 
If your application is successful, it is your responsibility to ensure that you, and where applicable your parent or guardian, are available at the times as specified to attend the location of the audition and/or filming of the Programme as applicable. It is the responsibility of the applicant to bring valid proof of age and eligibility and to make their own way to such specified location, unless otherwise stated. You will be required tocomply with any directions and/or instructions given to you, including, without limitation, in regard to conformity with the Ofcom Broadcasting Code, health and safety instructions and all relevant laws, rules and regulations. Failure to provide valid proof of age and eligibility or to comply with any directions or regulations will result in that applicant no longer being permitted to proceed further.
 
Neither the Production Company nor ITV is liable to refund any costs or expenses incurred in applying, or in participating in the Programme, including but not limited to the cost of calls made, postage, internet access fees, travelling expenses, transportation, accommodation, meals, drinks, insurance, taxes and costs unless otherwise provided for.
 
5. General rules
The Production Company, ITV and their sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, software provider or otherwise which may result in any application not being properly received or recorded.
 
The Production Company and/or ITV cannot promise that the system and/or service will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The system and/or service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of the Production Company or ITV. Neither the Production Company nor ITV will be liable to you or to any other person in the event that all or any part of the system and/or service is discontinued, modified or changed in any way.
 
Neither the Production Company nor ITV is responsible for any irregularities, industrial action, delay or other disruption in the postal service, and will not be held liable in any such event.
 
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
 
6. Queries/Complaints
If you have a query or complaint about your application, you may register it with the ITV duty office who can be contacted by phone on 0844 88 14150, or by email at dutyoffice@itv.com. You will need to give the following information:
 
(a)   Your Name
(b)   The telephone number of the phone you called from if applicable
(c)   Confirmation of the website, phone number, or postal address you have been applying through
(d)   Where applicable, your telephone network operator or the IP number of your computer and your internet service provider
(e)   The time(s) when you applied and experienced problems
(f)    The nature of your query or complaint
(g)   A contact telephone number you can be reached on if necessary
