These terms and conditions (“Submission Terms”) govern the relationship between you and ITV Studios Limited (“we”, “us”, “our”) when you submit clips to us in connection with the programmes “You’ve Been Framed!” and/or “…Funniest Things” via email or post (“Clip(s)”).
We recommend that you read these Submission Terms carefully before sending us any video Clip(s). By sending us Clip(s) you agree to be legally bound by these Submission Terms. If you do not agree with any of our Submission Terms you should not send us any Clip(s).
These Submission Terms may be amended or varied at any time by us without prior notice. It is your responsibility to ensure you review these Submission Terms regularly to familiarise yourself with any changes.
Submission of Clip(s) does not guarantee that they will be accepted for use in our programme(s). The clip fee of £250 is payable only when a Clip is used by us in our programme and only following initial transmission of such programme incorporating your Clip.
In contributing your Clip(s) to us, you agree to assign to us all rights, title and interest (including, without limitation, copyright) in those Clip(s) that are short-listed for possible use in our programme(s) (“Accepted Clip(s)”). We reserve the right to use Accepted Clip(s) in our programmes, including programmes other than “You’ve Been Framed!” and “…Funniest Things”.
If you are under the age of 18, you must have the permission of your parent or guardian before sending any Clip(s) to us.
1. Postal submissions
You may send your Clip(s) on tapes or DVDs to one of our Freepost address: Freepost You’ve Been Framed or Freepost Funniest Things. Please send copies not originals, as we cannot guarantee that your tape or DVD will be returned to you. Tapes and DVDs are supplied at your own risk and we do not accept any liability if they are lost or damaged.
On receipt of a tape or DVD, the company that operates our tape storage facility (“Storage Company”) will send you an acknowledgement letter.
We will review your Clip(s) and decide whether or not they are suitable for possible use in our programmes. However, due to the high volume of Clips we receive, we cannot guarantee when we will review your Clip(s).
If your Clip(s) are rejected, we endeavour to ensure that your tape or DVD is returned to you by the Storage Company together with a rejection letter. However, we cannot guarantee that your tape or DVD will be returned to you.
If your Clip(s) are short-listed for possible use in our programmes, we will make a copy of the Clip(s) on our systems and we endeavour to ensure that your tape or DVD is then returned to you by the Storage Company together with an acceptance letter. You will later receive a questionnaire and consent forms from us which must be completed.
2. Email submissions
You may send your Clip(s) to us via email to either framed@itv.com or funniestthings@itv.com.
On receipt of your Clip(s), you will receive an automated acknowledgement.
We will review your Clip(s) and decide whether or not they are suitable for possible use in our programmes. However, due to the high volume of Clips we received, we cannot guarantee when we will review your Clip(s).
No notification will be given to you if your Clip(s) are rejected and we will delete the clip from our systems.
If your Clip(s) are short-listed for possible use in our programmes, we will make a copy of the Clip(s) on our systems and you will receive a questionnaire and consent forms from us which must be completed.
3. General Rules
By submitting contribution(s) to us, you agree that we and/or authorized third parties may contact you for publicity in connection with the programme and/or interactive service and/or for participation in the programme. We do not guarantee that all persons who have contacted us will be contacted.
You acknowledge and agree that we may in our sole discretion include your contribution and your personal details in our programme(s) and/or in any future episode of the programme(s), on website(s) including without limitation on www.itv.com or in any other media in connection with the programme and/or to broadcast or otherwise make it public via any media or otherwise exploit it in any manner.
You agree that all or part of your contribution including your personal details may be edited, adapted, displayed or published in all media and/or otherwise made publicly available in the discretion of us and/or authorized parties. If we, in our sole discretion, deem it necessary to do so we may disguise and/or conceal the identity of a participant in the interactive service. If you make contribution(s) via method(s) or media which are available to the public, we recommend that you do not disclose personal contact information including but not limited to addresses or phone numbers.
We may require you to provide proof of age and eligibility, and you may further be required by us and/or authorized parties to provide your signature as proof of your agreement to any relevant waivers, releases and/or consent. Failure to provide valid and current proof of age and/or eligibility or to provide your signature as required may result in your contribution no longer being considered.
We do not guarantee that your contribution(s) will be considered, broadcast on-air and/or in any other media and/or used despite being received by us, even if you have received an acknowledgment of sent and/or receipt message. Please note that not all contribution(s) will be considered, broadcast or used. We do not represent, undertake or warrant that it will broadcast in any media any future episode of the programme which may or may not include your participation in the interactive service. We may suspend, withdraw or re-set the interactive service in our sole discretion at any time.
We and/or authorized third parties may modify any contribution(s), or we may accept it in whole or in part, or refuse to consider it in our sole and absolute discretion. All contribution(s) are considered as “Submissions” (as defined under the Terms of Use at www.itv.com/terms) and are subject to such Terms of Use. When you participate in the interactive service, your contribution(s) may be moderated and will be subject to the restrictions and guidelines including without limitation the following: You should not make contribution(s) containing any material which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. You agree not to advertise or promote third parties' or your own goods or services including by way of the distribution of "spam". Unless otherwise stated, contributions should not contain any music. Any such contribution(s) may be deemed unsuitable and not accepted. You promise that you will not submit any contribution(s) which in any way infringe the rights of a third party, or which infringe any applicable laws.
Neither we, nor the ITV group of companies or any of our agents and sub-contractors bear any responsibility for any contribution(s) which is incorrectly addressed, lost in transit, or damaged or interrupted in any way. Contribution(s) sent in by post is deemed received upon arrival at our Storage Company. We are not responsible for any irregularities, industrial action or disruption affecting any delivery method and we will not be held liable in any such event.
We cannot promise that the interactive service and/or system will be free from errors or omissions, nor that it will be available uninterrupted and in a fully operating condition. We do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem including without limitation with any telecommunications network or line, system, delivery system or technology, software, server, service, provider which may result in any contribution being lost or not properly received, registered, heard or recorded.
We reserve the right to vary any element of the interactive service and/or to suspend or discontinue the interactive service without notice, due to system failure, maintenance or repair or for reasons beyond our reasonable control including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with a law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. We will not be liable to you or to any other person in the event that all or any part of the interactive service and/or system is discontinued, suspended, modified or changed in any way.
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
4. Privacy
Information and data ("personal data") which is provided by you when you participate in the interactive service will be held and used by us, the ITV group of companies, and any service providers, network operators, suppliers and contractors in connection with your participation in the interactive service and the programme where applicable.
Any personal data will be used in accordance with ITV’s privacy policy. For ITV’s full privacy policy and how your data will be used, go to www.itv.com/privacypolicy.
We will only pass your data to third parties for marketing purposes if you have accepted to receive marketing information from those third parties.
