Mother pledges to continue fight for son's human rights

Susan Smith from Staffordshire says that if judges rule against her it would mean her son Phillip Hewett has no right to live because he is a serving soldier.

She says she will continue her legal fight if the Supreme Court does not grant her the right to sue the Ministry of Defence.

Soldiers' families 'can sue MoD'

The Supreme Court has ruled that relatives of three soldiers killed in Iraq can sue the MoD for damages. The families say it failed to provide them sufficient protection after they were killed by roadside bombs while in lightly armoured Land Rovers.
