In a statement released through her publicist, the 52-year-old actress said she was out of the country at the time but the death at a party hosted by her assistant was an "unthinkable tragedy".

The victim, Edenilson Valle, had gone missing for 10 or 15 minutes before his friends found him floating in the deep end of the pool yesterday morning, said coroner's official Lieutenant Fred Corral.

Mr Valle's family and friends told investigators he did not know how to swim.

Police went to the home on the 9000 block of Oak Pass Road in west Los Angeles after receiving a 911 call. A small crowd was around the man's body when police officers arrived.

Paramedics started CPR, but Mr Valle was pronounced dead at the scene at 5.30am.

"I was out of the country travelling to meet my daughters for a birthday celebration when I got the devastating news," Moore said in the statement, adding that "my heart goes out to this young man's family and friends".

Moore's youngest daughter, Scout LaRue, turns 24 today.

Ashton Kutcher has filed court divorce papers to end his seven-year marriage to actress Demi Moore. The Two And A Half Men star's petition cites irreconcilable differences but does not list a date that the couple separated.

Demi, 50, announced last year that she was ending her marriage to the actor, who at 34, is 15 years her junior, but she never filed a petition.

Community service for Willis's daughter

Demi Moore and Bruce Willis's daughter Scout can do community service to resolve her public drinking and fake ID case, a US judge has said.

Willis, who is now 21, was excused from court as a Manhattan judge agreed to dismiss her misdemeanour case if she does two days of service.

She did not have to enter a plea in the case.

Her lawyer, Stacey Richman, said prosecutors "took a logical approach to assessing the situation".

The arrangement in Willis's case, known as an adjournment in contemplation of dismissal, is often offered to defendants in first-time misdemeanour cases.

She was arrested on June 4. A court complaint said she was sipping beer in public in violation of an open-container law.

Willis, who was 20 at the time, gave police an ID card with a false name before showing her real ID, according to a complaint. This led to a misdemeanour impersonation charge.
