The Stockton North MP Alex Cunningham has successfully steered his 'smoke free private vehicles Bill' through its first parliamentary hurdle.
Mr Cunningham wants to make it illegal to smoke in a car when there are children passengers.
He claims that it is not only a health measure, but also a child protection move.
The Stockton MP said South Africa, Bahrain and several Australian states had already passed similar laws.
His Bill will return to the floor of the Commons in early February.
It has already been through the House of Lords where its primary sponsor was a former senior surgeon Lord Riberio.
