BORN TO SHINE VOTE: INTERACTION INFORMATION

Opening / Closing times:
Viewers may vote for which celebrity contestant(s) they wish to keep in the competition as featured in the show, ‘Born to Shine’ (the ‘Programme’). Voting lines open and close at the times as stated in the Programme.

Voting method:
Viewers may dial the premium rate telephone (PRTS) number for their chosen celebrity contestant(s) as shown in the Programme and listen to the recorded message which confirms the vote.  Please note that unless otherwise specified, is not possible to vote via SMS, the internet, via email or via any method not specified here.

Voting cost:
Each PRTS vote costs no more than 51 pence from a BT landline. Calls from other networks may be higher and from mobiles considerably more. The total cost will be dependent on the viewer’s network operator. Viewers can find out more information about the amount that their mobile operator will charge them by visiting http://www.callcosts.co.uk; but the Promoter and producers of the Programme recommend that for the most up to date charges viewers enquire directly with their mobile network operator.

Charitable donation:
35.9 pence from the cost of each PRTS vote goes to the charity, Save the Children (the “charity”, registered in England and Wales, registered charity number 213890 and in Scotland SC039570).

Voting restrictions:
Viewers may vote as many times as they like, however the Promoter believes that any votes for one celebrity contestant which are received from any one recognised number in excess of 1000 votes are deemed to be designed to excessively manipulate the outcome of the vote and are unfair to other users and other celebrity contestants. Therefore if a viewer votes more than 1000 times for one celebrity contestant from any one platform, the Promoter and the Programme producers reserve the right in their sole discretion to disqualify any votes made above that number, having regard to all the circumstances and information available at the relevant time.

Voting results and contingencies:
The celebrity contestant with the highest number of viewer votes will proceed to the next round in the competition i.e. the final (the “final”) which takes place in the final episode of the Programme. One member of a panel of judges (the “Panel”) will be nominated to be the head judge (the ‘Head Judge’).

In the event of a tie where two or more celebrity contestants have joint highest votes from the viewer votes the Head Judge will determine the outcome and/or which celebrity contestant(s) is eliminated from the competition or goes through to the final. The Head Judge’s decision is final.

In the event that the outcome of a vote cannot be reasonably determined because of a technical failure or other circumstance beyond the reasonable control of the Promoter, the producer of the Programme or their agents or sub-contractors, the Head Judge will determine the outcome and/or which celebrity contestant(s) is eliminated from the competition or goes through to the final. The Head Judge’s decision is final.

In the event that a technical failure or other circumstance beyond the reasonable control of the Promoter, the producer of the Programme or their agents or sub-contractors occurs which prevents a vote from taking place entirely, the Panel will decide which celebrity contestant(s) will stay or be eliminated from the competition and if the Panel cannot reach a decision, the Head Judge will decide which celebrity contestant will stay or be eliminated from the competition. The Head Judge’s decision is final.

In the final there is no viewer vote, instead each celebrity contestant who as a result of the viewer vote was eliminated in a previous episode of the Programme, will become a member of a contestant panel who will decide the outcome of the competition in the final (the “Contestant Panel”). The celebrity contestant with the most votes from the Contestant Panel will be declared the winner of the competition and the Contestant Panel’s decision is final.

In the event of a tie in the vote of the Contestant Panel, or in the event of a technical failure or other circumstances beyond the reasonable control of the Promoter, the producer of the Programme, their agents or sub-contractors, the Head Judge will determine the outcome. The Head Judge’s decision will be final.

If any celebrity contestant is unable to or is prevented from performing fully in the Programme due to medical reasons, or for other reasons which are beyond the control of the Promoter and/or the producers of the Programme, then the producers of the Programme will decide whether that celebrity contestant will continue in the competition, having regard to all circumstances and information available to them at the relevant time. The producers of the Programme will in their sole discretion determine if another celebrity contestant may be allowed to enter the competition.

Any variation on the format of voting, celebrity contestant elimination and/or judging as set out in these terms and conditions will be announced in the Programme and such format as announced in the Programme will prevail.
