DANCING ON ICE 2012 VOTE: REPUBLIC OF IRELAND VOTING INTERACTION INFORMATION
These terms and conditions are applicable to votes cast solely in the Republic of Ireland (the “Irish Vote”) and apply as between you, the viewer of the TV3 broadcast of the Dancing on Ice programme in the Republic of Ireland, and us, TV3, the promoter of the Dancing on Ice vote in the Republic of Ireland.
Voting method and cost:
Viewers in the Republic of Ireland can vote for the acts they wish to keep in the competition on Dancing on Ice programme (the “programme”).
You may register your vote by the dialling the PRTS numbers listed on www.tv3.ie/doivote or, where applicable, as shown on the TV3 broadcast. Please remember to dial carefully. You will hear a short message thanking you for your vote. Each phone vote costs 60 cent, incl. VAT from an Eircom landline. Calls from other networks may be higher and from mobiles will be considerably more. The total cost will be dependent on your network operator.
A helpline is available to Irish viewers on direct dial 0818 205 354. The cost of this call will be the cost of a national rate call charged by the caller’s network operator.
If there are technical or other issues with the Irish Vote including without limitation any error in publishing the Irish Vote numbers, the producer reserves the right to discount the Irish Votes, and announce the result of the vote without including those affected votes.
The broadcaster of the programme in the UK, ITV, is not responsible for any vote services promoted outside the UK and Channel Islands as these are not within its control. The programme producers reserve the right to discount votes if they have reasonable grounds to suspect they have been made from outside the UK, Channel Islands and Republic of Ireland or otherwise in breach of any applicable voting terms and conditions.
If for any reason there is a discrepancy between Irish Vote numbers advertised on air (where applicable) in the Irish broadcast and those given on any other platforms (including on the TV3 website) then the numbers on air will prevail and the vote shall proceed on that basis.
Please note that it is not possible to vote via any other method not specified here.
Opening/closing times:
Voting opens and closes as specified in the programme.
Voting restrictions:
While you may vote as many times as you like, votes received from any one recognised number in excess of 1000 for one act are deemed to be designed to excessively manipulate the outcome of the vote and are unfair to other users and other acts. Therefore if you vote more than 1000 times for one act from any one platform, the programme producer reserve the right, in its absolute discretion, to disqualify any votes made above that number.
Vote scoring system:
With the exception of the Final where the winner will be determined solely by the viewers’ vote and unless otherwise specified in the programme, the scoring system works on a points system which ranks the marks from the judges and the results of the audience vote and converts the rankings to points. The points scoring system works on a 50:50 basis. Fifty percent of the contestants’ total points come from the judges’ marks and fifty percent comes from the viewers’ vote.
The judges will score each performance with a certain number of marks and, where announced in the programme at the producers’ discretion, the Head Judge may also award extra ‘style’ or ‘technique’ marks. The total judges’ marks are then translated into points where the maximum number of points available is based on the total number of skaters left in the competition (for example if there are 6 skaters left, the highest available point will be six).
ITV may in its discretion introduce additional tasks or challenges (for example, team challenges) which may give the contestants the opportunity to gain additional marks before the judges’ marks are translated into points. If ITV elects to include such tasks or challenges then the introduction of these elements or challenges and how any additional marks will be awarded will be announced in the programme.
If there is a tie in the judges’ marks, the tied acts will all receive the same number of points and the act below them will receive one less point.
The viewer votes are translated in a similar way – i.e. the couple who receive the most votes will receive the maximum number of points.
The “translated points” from the Judges scores and the Viewer Votes are then combined in order to rank the players and the two or more contestants with the lowest combined scores are required to perform again in the “skate off” to determine who remains in the competition as set out below.
There may be certain tasks and/or challenges introduced at ITV’s discretion which enable certain contestants or groups of contestants to be “immune” from the public vote and they will continue to the next stage of the competition. The introduction of any “immunity” element will be announced in the programme.
Please note that for the Final, the Judges scores will not be combined with the Viewer votes. The viewer votes alone will determine the results in the Final.
Vote results and elimination:
Each week (except for the Final), at the discretion of ITV or the programme producer:
· the two or more contestants with the lowest combined points are required to perform again (the “skate-off”) to determine who remains in the competition as set out below; and/or
· any other combination of eliminations based on the combined points and/or the judges’ decision and/or the viewer vote in a skate-off will apply; and/or
· there may be certain tasks and/or challenges at ITV’s discretion which enable certain contestants or groups of contestants to be “immune” from the public vote.
In each case, the elimination format, and any specific terms relating to that week’s elimination, will be announced in the applicable on-air interaction information. Unless explained otherwise in the applicable on-air interaction information, following the “skate-off”, either the Judges will decide which contestant is eliminated or the other contestants not in the skate-off will vote for the contestant to be eliminated from the programme. Please note that ITV reserves the right to alter the voting mechanism at any point during the series (any such alteration will be announced in the applicable on-air interaction information).
Final: In the final programme, subject to the following, the winner will be determined solely by the viewers’ votes. The phone lines for the vote will be open for a limited period during which viewers will vote for who they wish to skate “Bolero”. The results of the public vote at the time of lines being closed will be announced and the contestant with the least public votes will be eliminated from the competition. An on air announcement will be given to inform viewers when voting lines have re-opened and the public can vote for who out of the remaining contestants they wish to be the overall winner. For the avoidance of doubt, all votes received by acts going through to the final stage of voting prior to the lines being closed are not carried forward to the final stage of voting.
Contingencies
If a contestant is unable to or is prevented from performing fully in the programme due to medical reasons, or for other reasons which are beyond the control of ITV and/or the producers of the programme, then the producers will decide whether that contestant will continue in the competition, having regard to all circumstances and information available to them at the relevant time.
If, following their performance, a contestant is then unable to or is prevented from performing fully in a “skate-off” due to an injury or any other medical reason, or for other reasons which are beyond the control of ITV and/or the producers of the programme but may be able to continue in the later stages of the competition, then the performances of all the contestants earlier in the evening on that show due to appear in the “skate-off” will be replayed unless the contestants have prepared a special routine for the “skate-off”. Where contestants have prepared a special routine for the “skate-off” then those able to skate will perform their routine live and the dress rehearsal will be shown for the contestant(s) unable to perform in that skate-off. The judges (unless explained otherwise in the applicable on-air interaction information) will then decide which contestant is eliminated based on that performance alone (for the avoidance of doubt performances from previous episodes will not be replayed).
A standby contestant may be allowed to enter the competition at the discretion of the producers.
Episodes 1 and 2: In the event of a tie between two or more contestants in their combined scores then the viewer vote will decide the result. If the viewer vote is tied or if the result cannot be reasonably determined because of a technical failure or other circumstance beyond the producers’ or ITV’s reasonable control, then the judges’ scores will decide who performs in the skate off and/or who will be eliminated following the skate-off. If the judges’ scores are tied, then the Head Judge will decide who performs in the skate-off and/or who should be eliminated following the skate-off.
Episodes 3-11:
If there is a tie between two or more contestants in their combined points, the viewers’ vote on that night will determine the two contestants who will perform in the skate-off. If the viewers’ vote on that night is also tied, then the total viewers’ votes across the series to date (or from when a standby contestant entered the competition if applicable) will determine who will perform in the skate-off (“Total Viewer Votes”). If the Total Viewer Votes are also tied then the Head Judge will determine who will perform in the skate-off. If historical viewer vote numbers are not available (for example, for a standby contestant) then the judges’ score for that night will determine who will perform in the skate-off. If the judges’ score for that night are also tied then the Head Judge will determine who will perform in the skate-off.
If the result cannot be reasonably determined because of a technical failure or other circumstances beyond the producers’ or ITV’s reasonable control, the Total Viewer Votes plus the judges’ score for that night will determine the two contestants who will perform in the skate off. If the Total Viewer Votes plus the judges’ score for that night are also tied then the Head Judge will determine who will perform in the skate-off.
If following the “skate-off” the other contestants (not in the skate-off) are instructed to vote for a contestant to be eliminated from the programme, and those contestants’ votes are tied or if the contestants are unwilling to vote, the producers can at their discretion revert to the judges or the head judge alone to decide who should be eliminated following the skate-off.
The final: In the final programme, the result will be determined solely by the viewers’ votes. In the event of a tie between two or more contestants in the viewers’ vote, or if the result cannot be reasonably determined because of a technical failure or other circumstance beyond the producers’ or ITV’s reasonable control, then the Total Viewer Votes across the series (or from when a standby contestant entered the competition if applicable) will determine which contestant will be the first to leave the competition. In the event the Total Viewer Votes are also tied then the head judge will determine which contestant will be the first to leave the competition. In the event of a tie in the viewers’ votes between the final two contestants, then the Total Viewer Votes will determine the overall winner of the competition. In the event of a tie in the Total Viewer Votes then the head judge will determine the overall winner of the competition. The head judge’s decision will be final.
If a contestant is injured during the final programme and is unable to further perform in the programme, ITV reserves the right to cancel the viewer’s vote for that contestant. Where the injured contestant is one of two finalists, the judges and/or ITV reserves the right to determine the outcome of the competition.
Please note that the Total Viewer Votes will not include the viewer votes cast in any vote from which some of the contestants have been granted immunity.
General
Nothing in these terms and conditions restricts your statutory rights as a consumer. Nothing in these terms and conditions shall exclude or limit the programme producer’s, ITV’s or TV3 group’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
Except as set out above, the TV3 group (“TV3”), ITV and/or the programme producers do not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by you as an entrant or participant howsoever arising from participating in a competition, vote or poll or from accepting any prize whether due to any error, omission or other cause by TV3, ITV the programme producers or its or their employees, agents or others.
Except as set out above, none of TV3, ITV or the programme producers is responsible for any damage or loss caused to you (i) which is not reasonably foreseeable to you and to TV3, ITV or the programme producers when you agree to these terms and conditions (which occurs automatically when you vote) or (ii) is reasonably foreseeable to you and to TV3, the programme producers and/or ITV when you agree to the terms and conditions but is only indirectly related to you participating in a vote.
