DAYBREAK ‘THE DOG’S FROLICS’: INTERACTION INFORMATION
 
Opening/closing date & time:
·             Entry period opens for entries at 06:00 on Thursday 26th January 2012.
·             Entry period closes for entries at midday on Monday 30 January 2012.
 
Eligibility criteria:
Entrants must meet the following criteria:
 
(a)                 Must be aged 18 or over;
(b)                 Must be the owner of the dog being entered;
(c)                 Must be a UK (including Northern Ireland), Channel Islands or Isle of Man resident, meaning they must ordinarily be living in the UK (including Northern Ireland), Channel Islands or Isle of Man for the duration of Daybreak’s ‘The Dog’s Frolics’.
(d)                 Must not be employed or engaged by the Promoter, programme producers (the “producers”) or companies within their group of companies or be a live-in partner or immediate relative (i.e. mother, father, son, daughter, brother or sister) of an employee of the Promoter, producers or persons professionally associated with Daybreak’s ‘The Dog’s Frolics’;
(e)                 Must disclose to the producers when asked, details of any and all convictions and actions pending against them currently and/or any unspent convictions other than driving offences which have not resulted in a ban. At the sole discretion of the producers, certain convictions or pending criminal proceedings against an entrant may invalidate their entry or otherwise result in the termination of their participation in the programme;
(f)                   Must ensure that the dog has no health concerns which might impact on it or others or upon its ability to appear on television or take part in filming;
(g)                 Must be prepared to allow their dog to undergo a mandatory check up by a veterinarian in connection with the dog’s participation in Daybreak’s ‘The Dog’s Frolics’. Refusal to allow any entered dog to undergo a veterinarian check up may, in the Promoter’s sole discretion, result in the disqualification of the entrant; and
(h)                 Must be available to be contacted, and for filming purposes or otherwise on specified dates, including but not limited to dates during the period between 1 February 2012 and 10 February 2012 inclusive or such other date or dates as may be specified by the Promoter and/or producers.
 
You agree that you have control over your dog and that your dog has a suitable temperament to be around other people and other animals without displaying violent or aggressive behaviour. You further agree that your dog has not been the subject of any action or proceedings in relation to out of control or dangerous behaviour, including without limitation any proceedings brought under the Dangerous Dogs Act 1991 (as amended).
 
Proof of eligibility may be required.
 
Failure to comply with the eligibility or entry criteria as set out in these terms and conditions, and elsewhere as applicable or failure to comply with instructions and/or directions given or with these terms and conditions in any way may result in disqualification from participation. For the avoidance of doubt, if we suspect that an entrant is not eligible to participate we reserve the right to terminate or suspend their further participation and that entrant forfeits any claim to participate further in the feature.
 
By entering your dog to participate in this feature you agree to comply with these terms and conditions, and you agree that you may be contacted by the producers and the Promoter, and that you may be required for filming purposes and/or other appearances at any time for simultaneous or later broadcast in any media, and that your entry and your name may be published in all media, adapted, in whole or in part, or otherwise exploited in any manner, including but not limited to publication on www.itv.com in the Promoter’s sole discretion. (the “website”)
 
Method of entry:
Go to the website at www.itv.com/daybreak and follow the instructions to access and complete the online entry form (including the option to upload a video of the entered dog).
 
An entrant may only submit one entry per dog, and each dog entered cannot then be entered by another entrant in a separate entry. An entrant may submit more than one of their dogs for consideration. Entries above the maximum number permitted or which are incomplete, incomprehensible, illegible, or which are received or submitted after the deadline for receipt of entries will be invalid and will not be considered.
 
Please note that there is no other method of entry other than as specified in these terms and conditions. The Promoter and the producers bear no responsibility for any entry which is incorrectly submitted, lost due to technical problems, or damaged in any way. The Promoter and/or the producers will not acknowledge receipt of any entry.
 
Entry criteria:
 
By submitting a recent photograph of your dog (taken in the last 12 months) OR a video of your dog (taken in the last 12 months) which should be a maximum of 15 seconds long (if an entry above 15 seconds in length is submitted the Promoter will only consider the first 15 seconds of the video) along with a short (no more than 150 words) summary of the naughtiness which has prompted you to enter your dog.
 
Each entrant warrants and represents that he/she owns the rights to the photograph and any video submitted. The entrant agrees that they will not submit an entry to the feature which contains any information which in any way infringes the copyright or other rights of a third party, or which infringes any applicable laws and that the information they provide is accurate and up to date. The entry must not contain any information which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability.
 
Cost of entry:
There is no charge for entry but internet service provider’s fees may apply when accessing the internet.
 
Selection criteria:
All entries will be judged on the basis of the appeal of the entry including, but not limited to, whether the entry suggests that the inclusion of the dog in the feature would provide a strong editorial story for the programme.
 
Selection process:
 
All eligible entries received by the closing date and time will be reviewed by the programme production team between Monday 30 January 2012 and Friday 10 February 2012 (inclusive). A selection of entries will then be reviewed by a panel which will consist of the programme production team and a dog behavioural expert. The panel will evaluate all eligible submissions and will select those entries which the panel consider best meet the selection criteria (the “appropriate candidates”).
 
Each appropriate candidate will be contacted for confirmation of eligibility and compliance with the entry criteria. Failure to comply with any criteria may result in disqualification of an appropriate candidate and another entrant being selected by the panel from the entries received and contacted to become an appropriate candidate instead. Each appropriate candidate will be contacted as soon as reasonably practicable following the selection of the appropriate candidates. The Promoter will make reasonable efforts to contact each appropriate candidate. If an appropriate candidate cannot be contacted this may result in forfeiture of their position as an appropriate candidate and the Promoter reserves the right to disqualify that entrant (without further liability to that entrant) and offer the position as an appropriate candidate to another entrant and thereafter until an eligible candidate is found. Note that the appropriate candidate will be required to participate in the programme and be filmed/photographed.
 
Please note that, unless otherwise specified, it is the responsibility of the entrant to arrange and pay for their own travel expenses to any location as specified for participation in Daybreak’s ‘The Dog’s Frolics’, as well as any accommodation expenses, parking costs, car hire, meals, drinks, excursions, treatments, telephone calls including local and long distance telephone calls, hotel charges, spending money, personal items, merchandise and souvenirs, incidental costs, visas, taxes, insurance and any other costs, charges, taxes or expenses which may be incurred when entering Daybreak’s ‘The Dog’s Frolics’.
 
For the avoidance of doubt, the producers reserve the right to publish any entrant’s entry and/or to film any entrant’s appearance at any location at any time for simultaneous or later broadcast in the programme or otherwise, in any media in whole or in part. The selection process and the announcement of the appropriate candidates may, in the sole discretion of the producers, be filmed on such dates as may be determined by the producers and broadcast on the programme and/or on the website at any time. It is the responsibility of the entrant to inform the producers of any wheelchair or similar access requirements and to adhere to any applicable health and safety guidelines and other instructions.
 
In the event that any of the appropriate candidates are unable for any reason (including, but not limited to, illness or unavailability of the entered dog) to take part in the feature the Promoter reserves the right in its sole discretion to disqualify that entrant (without further liability to that entrant) and offer the position as an appropriate candidate to another entrant and thereafter until an eligible candidate is found.
 
General:
By making an entry and participating in this feature, you grant the Promoter permission to use the entry in any way it wants. This means that the Promoter can use, edit, reproduce, record, modify, translate, distribute, play, perform, broadcast, make available and display your entry and/or participation (or part thereof) and/or prepare derivative works of the entry and/or participation by any medium or method whether now known or later developed, including without limitation on the website or any other website in its sole discretion anywhere in the world. The Promoter may permit third parties to use the entry. You acknowledge that you will not receive any fee or royalty payment from the Promoter or any third party for the consents and grants given by you in relation to your entry and/or participation.
 
You confirm and agree that you are fully authorised and entitled to grant this permission. You agree to give us evidence of this authority and entitlement if requested by us. You agree to waive any moral rights that may exist in relation to your entry. This means that you waive the right to complain about the way in which the Promoter and/or producers may edit, alter or use the entry and that the Promoter and/or producers do not have to identify you.
 
The Promoter and/or the producer of the programme do not guarantee, represent, undertake or warrant that it will produce the feature, that it will contact every entrant or broadcast or feature their entry and/or participation or otherwise exploit in any manner any content which may or may not include their entry and/or participation. Unless otherwise specified, the Promoter is not liable to refund any costs or expenses incurred in entering the competition including but not limited to internet access fees, any phone calls made, travel costs and accommodation, incidental costs, charges, fees, expenses and taxes. Unless otherwise specified, the Promoter is not liable to refund any costs or expenses incurred in entering Daybreak’s ‘The Dog’s Frolics’ including but not limited to internet access fees, any phone calls made, travel costs and accommodation, incidental costs, charges, fees, expenses and taxes.
 
This feature and these terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English Courts.
