ITV1 CHRISTMAS SHOW: GENERAL PROGRAMME PARTICIPATION TERMS AND CONDITIONS
1. General guidelines
Where stated in on www.itv.com/beontv, on other websites and in other print and email promotions you may apply or nominate another person to participate in the new ITV1 Christmas show (the ‘programme’) by 5 p.m. on Friday 11 December. You must comply with any deadline for submissions where stated. Please note it is not possible to apply via any other method not provided for here.
2. Eligibility
To be eligible you and the person you nominate (if applicable) must be a UK resident aged 18 or over, except where children are nominated by their parents or guardians. Parents nominating their children should ensure that all requested information on the application form is filled out or applications will not be considered. The programme producer will contact parents or guardians of children aged under 18 years of age and may require additional involvement or consent from another parent or guardian during the process of recruiting and/or filming, as applicable. Employees and members of their immediate families (including any live-in partner) of companies within the ITV group of companies and any of their subsidiaries and/or agencies associated with the programme including the programme producer are ineligible to apply. Any such application will be invalid.
If we suspect that an applicant is not eligible, we reserve the right to invalidate their application or nomination of another person.
By nominating another person to participate in the programme you agree that you have the consent of that person if selected to participate in the programme, unless you are nominating another person to participate in the programme with the intention of surprising that person and you have no reason to believe that that person would object to being so nominated. The programme producer may contact you by telephone to further discuss your proposed nomination before proceeding.
It is the responsibility of the applicant and/or the person making the nomination to ensure that the information provided is complete, comprehensible, correct, up-to-date and submitted ahead of the stated deadline for applications. Providing information which is incomplete,incomprehensible, false or not received by the closing date and time for the completed application forms (as specified below) will mean that the application/nomination is invalid and will not be considered.
Applying or nominating another person to participate in the programme signifies acceptance of these terms and conditions.
3. Application process
Eligible applicants may request an application form by email only.
You may request an application form by sending an email to the email address as stated on the www.itv.com/beontv website or other website promotion or in other print and email promotions, stating that you wish to participate in the programme, and providing a valid email address, along with your name and any other requested information as requested in the promotion.
The programme producer endeavors to email an application form to each person who has correctly followed the instructions and requested an application form. There is no restriction on the number of times you may request an application form.
An application form will then be sent to applicants and applicants are required to complete the application form providing any required information as specified on the form. Completed application forms must then be returned by email to the email address specified on the form or by post to the postal address specified on the form and must be accompanied by a photograph of yourself, and if you are nominating someone else, a photograph of the person you are nominating.
It is the responsibility of the applicant to ensure they submit the completed application form ahead of the closing date and time for applications and that they follow the instructions specified. Failure to follow any instructions, submit application forms by the closing date and time and provide information as required may result in that application being invalid.
Any information and data provided when applying will be held and used by ITV and the production company, their sub-contractors and agents, in order to administer the application for the purpose of producing, promoting and exploiting the programme, in accordance with the provisions of ITV’s privacy policy. Participation in the programme is subject to health and access restrictions.
By applying to participate in the programme, the applicant accepts these terms and conditions and consents to being filmed and recorded, and the applicant permits ITV, its successors and assigns any and all rights of whatever kind to use, and to permit others to use, all or any part of recordings of any type made of the applicant’s appearance on the programme in any and all media now known or hereafter devised or invented and by any means throughout the world in perpetuity, and by means of publicity and promotion relating to the programme.
Any submitted materials may be considered as “Submissions” (as defined under the Terms of Use at www.itv.com/terms) and are subject to such Terms of Use.
4. Application closing date and time
The closing date for receipt of the completed application form is 5:00 p.m. on Friday 11 December 2009. If applicants have not heard from the programme producer or ITV by Monday 14 December 2009 they have not been successful in their application.
Applications sent and/or received by ITV and/or the programme producer after the closing date and time for receipt of applications, or which contain false information, or are misleading, incomplete, incomprehensible, incorrectly addressed, lost in transit, or not received are void and will not be considered. ITV and/or the programme producer cannot accept responsibility for any application which is not received by the closing date and time. ITV and/or the programme producer reserves the right to invalidate any application received.
You may apply as many times as you like. ITV and/or the programme producer cannot acknowledge receipt of applications. ITV and/or the programme producer may suspend, withdraw or re-set this service in its sole discretion at any time.
5. Cost to apply
There is no charge when requesting an application form via email, although internet service provider’s fees may apply. There is no charge when returning an application form via email, but your internet service provider’s fees may apply when accessing the internet. There is no charge when returning an application form via post, but entrants must ensure that the correct postage is paid.
6. Selection process
The applicant acknowledges that by making an application that ITV and/or the programme producer reserves the right to contact any applicant for a future episode of the programme or to broadcast the applicant’s and their nominee’s participation in any other media or otherwise exploit it in any manner. ITV and/or the programme producer do not guarantee that all applications will be considered despite being received, and does not represent, undertake or warrant that it will contact all applicants or broadcast, or otherwise exploit in any manner, any future episode of the programme. In the event that ITV and/or the programme producer undertakes to exploit any aspect of your application or you or your nominee’s participation in the programme they will make reasonable endeavours to obtain your prior permission.
The programme producer will select in its sole discretion the most suitable applicant(s) to participate in the programme based on the information provided in the application form. If selected to participate in the programme, the applicant agrees to provide proof of age and identity and their signature as proof of waiver and/or consent to be filmed for the programme. Failure to provide such proof or signature as instructed will result in that applicant and/or nominee not being able to participate further in the programme and forfeiture of all rights to be in the programme. The decision of the programme producer is final and no correspondence will be entered into.
If selected to be in the programme, such applicant may be contacted either on the phone number, or at the email address provided at the time of the application. If they cannot be contacted, or they are not eligible and/or do not comply with terms and conditions as specified, then ITV and/or the programme producer reserves the right to select the next eligible applicant. It is the responsibility of the applicant to ensure that they and/or the person they have nominated, and where applicable their companion, are available on the date and time as specified by the programme producer, to attend at an address to be provided, and to appear on the programme on the agreed date and time in ITV’s and/or the programme producer’s discretion.
The applicant and/or nominee selected to be in the programme must comply with any instructions and/or directions as given to them by ITV, and/or the programme producer, their subcontractors and agents including without limitation in conformity with the Ofcom Broadcasting Code, health and safety instructionsand all relevant rules, laws, regulations and guidelines. Failure to comply with any directions or regulations will result in that applicant no longer being permitted to participate further in the programme. Unless otherwise specified, neither ITV nor the programme producer is liable to refund any costs or expenses incurred in applying or in participating in the programme including but not limited to the cost of calls made, internet access fees, travel costs, transportation, accommodation, meals, props, cost of repair and/or remodelling, restoration, incidental costs, insurance, expenses and taxes.
7. General terms
ITV and/or the programme producer may accept an application or refuse to consider it in their sole and absolute discretion. An applicant may not include in their application any material which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. Applicants further agree not to advertise or promote third parties' or their own goods or services including by way of the distribution of "spam". Any such submitted material will be deemed unsuitable and will not be accepted.
ITV, the programme producer and their sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, software, server, provider or otherwise which may result in any application being lost or not properly registered or recorded.
ITV cannot promise that the service and/or system will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The service and/or system may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of ITV. ITV will not be liable to you or to any other person in the event that all or any part of the service and/or system is discontinued, modified or changed in any way.
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
8. Queries/complaints
If you have a query or complaint about your application, you may register it with the ITV duty office who can be contacted by phone on 0844 88 14150, or by email at viewerservices@itv.com. You will need to give the following information:
(a) Your Name
(b) Your email address
(c) The IP number of your computer
(d) The date(s) and time(s) on which you experienced problems where relevant
(e) The nature of your query or complaint
(f) If possible, your internet service provider
(g) A contact telephone number you can be reached on, if necessary
