LORRAINE ‘BRITAIN’S BEST SOUP’ COMPETITION: INTERACTION INFORMATION
Opening/closing date & time:
· Submission period opens for entries as stated on ‘Lorraine’ (the “programme”).
· Submission period closes for entries at midday on Friday 14 October 2011.
· Vote opens online as stated in the programme on 24 November 2011.
· Vote closes online at midday on Friday 25 November 2011.
The vote open and close times may be subject to change in the sole discretion of the producers of the programme.
Eligibility criteria:
Entrants must meet the following criteria:
(a) Must be aged 18 or over;
(b) Must be a UK (including Northern Ireland) or Channel Islands resident, meaning they must ordinarily be living in the UK (including Northern Ireland) or Channel Islands for the duration of the competition. Note: correction of typographical error in the terms on 5 October 2011 to read including Northern Ireland.The soup will not be sold in Northern Ireland;
(c) Must not be employed or engaged by the Promoter, programme producers (the “producers”), Waitrose Limited (the “Prize Provider”) or companies within their group of companies or be a live-in partner or immediate relative (i.e. mother, father, son, daughter, brother or sister) of an employee of the Promoter, producers or persons professionally associated with the competition;
(d) Must disclose to the producers when asked, details of any and all convictions and actions pending against them currently and/or any unspent convictions other than driving offences which have not resulted in a ban. At the sole discretion of the producers, certain convictions or pending criminal proceedings against an entrant may invalidate their entry or otherwise result in the termination of their participation in the programme;
(e) Must be available to be contacted, and for filming purposes or otherwise on specified dates, including but not limited to dates during the period between Monday 31 October 2011 and Friday 11 November 2011 inclusive or such other date or dates as may be specified by the Promoter and/or producers;
(f) The three finalists must be available to feature on the programme during the period Monday 21 November 2011 to Thursday 24 November 2011 plus Monday 28 November 2011 or such other dates as may be specified by the Promoter or the producers; and
(g) The winner will be required to attend the launch of the soup at a Waitrose store or the programme studio on Monday 20 February 2012or such other date as specified by the Prize Provider.
Proof of eligibility may be required.
Failure to comply with the eligibility or entry criteria as set out in these terms and conditions, and elsewhere as applicable or failure to comply with instructions and/or directions given or with these terms and conditions in any way may result in disqualification from the competition. For the avoidance of doubt, if we suspect that an entrant is not eligible to participate in this competition, we reserve the right to terminate or suspend their further participation and that entrant forfeits any claim to participate further in the competition and/or to winning any prize.
By entering this competition you agree to comply with these terms and conditions, and you agree that you may be contacted by the producers and the Prize Provider, and that you may be required for filming purposes and/or other appearances at any time for simultaneous or later broadcast in any media, and that your entry and your name may be published in all media, adapted, in whole or in part, or otherwise exploited in any manner, including but not limited to publication on www.itv.com (the “website”) in the Promoter’s and/or the Prize Provider’s sole discretion (as appropriate).
Method of entry:
Go to the website at www.itv.com/lorraine and follow the instructions to access and complete the online entry form and submit the recipe.
An entrant may only submit one entry to this competition per phone number. Entries created by groups of individuals or organisations will be invalid and will not be entered into the competition. Entries above the maximum number permitted or which are incomplete, incomprehensible, illegible, or which are received or submitted after the deadline for receipt of entries will be invalid and will not be considered.
Please note that there is no other method of entry other than as specified in these terms and conditions. The Promoter, Prize Provider and the producers bear no responsibility for any entry which is incorrectly submitted, lost due to technical problems, or damaged in any way. The Promoter, Prize Provider and/or the producers will not acknowledge receipt of any entry.
Entry criteria:
By submitting an recipe each entrant warrants and represents that he/she owns the rights to the recipe submitted and that the written recipe submitted for that soup (a) is original, meaning that it is the entrant’s own work not having been copied from any pre-existing recipe and has been legally obtained and created; (b) is not commercially available in the UK or abroad; and (c) is edible and does not contain any ingredient (whether or not disclosed in the written recipe) which may be inedible, harmful or otherwise unsuitable or inappropriate in any way in the sole discretion of the producers and/or judges. The recipe should be for a savoury soup (as determined in the discretion of the judging panel) and must not contain nuts or shellfish. Recipes should not include garnishes.
The entrant agrees that they will not submit an entry to the competition which contains any information or product which in any way infringes the copyright or other rights of a third party, or which infringes any applicable laws and that the information they provide is accurate and up to date. The entry must not contain any information or product which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. The entrant agrees not to advertise or promote third parties' goods or services within their entry. Any such entry will be deemed inappropriate and will not be considered.
Cost of entry:
There is no charge for entry but internet service provider’s fees may apply when accessing the internet.
Selection criteria:
Entries will be judged based on the selection criteria including without limitation the ingredients used, the clear structure of the recipe, the ease of obtaining the ingredients and the possibility for the soup to be appealing to consumers and be commercially viable for mass production.
Selection process:
All eligible entries received by the closing date and time will be reviewed between Monday 17 October 2011 and Friday 28 October 2011 inclusive by a panel which will consist of Lorraine Kelly, the programme in-house chef Matt Tebutt, the Waitrose representative Stephanie Chafor and Mrs Kelly Senior (the “judging panel”). The judging panel will, based on the selection criteria, select up to twenty five (25) shortlisted entries (the “shortlisted entries”). The judging panel will meet again and in their sole discretion will rank each shortlisted entry in descending order beginning with the soup which best meets the selection criteria as indicated in these terms. The top three (3) soups which best meet the selection criteria will be a finalist (the “finalist(s)”). The soups of the finalists will be required to undergo testing by the Prize Provider to confirm that they can mass manufacture the soups. In the event that one or more of the finalist soups is deemed not suitable by the Prize Provider for mass manufacture (in the Prize Provider’s sole discretion) an alternative shortlisted entry may be contacted to become a finalist. The Prize Provider’s decision in this instance will be final. By entering this competition, each entrant acknowledges and agrees it may be necessary for the Prize Provider to make alterations to the recipe to make it suitable for mass production, which may affect the taste of the final product.
One member of the judging panel will be nominated to be the head judge who will determine who will be the shortlisted entry or finalist or who will win the prize in the event of a tie in the scoring or in the vote or other circumstance beyond the reasonable control of the Promoter and/or the producers. The decision of the judging panel or the head judge is final and no correspondence will be entered into.
Each finalist will be contacted for confirmation of eligibility and compliance with the entry criteria. Failure to comply with any criteria may result in disqualification of a finalist and another finalist being selected by the panel from the shortlisted entries and contacted to become a finalist instead.
During the period 21 November 2011 and 24 November 2011, each finalist will prepare their soup in-studio in London in the programme, and will be interviewed on the programme by the programme presenters.
Each finalist must supply their own ingredients to prepare their soup and will be required to disclose what ingredients they are bringing prior to attending the in-studio location to participate. The producers will check the ingredients of each finalist prior to their participation. Any ingredient which the producers, in their sole discretion, deem to be (without limitation) inedible, harmful, unsuitable, inappropriate or is an ingredient which does not correspond with the written recipe for that entrant’s soup as provided during the submission period will be excluded. In such event or in the event that a finalist’s recipe is deemed not to be original or otherwise fails to meet the entry criteria at any time, that finalist may, in the sole discretion of the producers, be disqualified from further participation in the competition and forfeiture of any claim to winning the prize and the producers may in their sole discretion select one of the remaining semi-finalist who ranked the next highest from amongst the list of semi-finalists as ranked by the judging panel to be a finalist. The decision of the producers will be final.
The finalists will then be entered into an online public vote on the website between Thursday 24 November 2011 and Friday 25 November 2011 inclusive (the “vote”). The results of the vote will be announced in the studio on Monday 28 November 2011 or such other date as determined in the producer’s discretion. For the avoidance of doubt, the producers reserve the right to publish any entrant’s entry and/or to film any entrant’s appearance at any location at any time for simultaneous or later broadcast in the programme or otherwise, in any media in whole or in part. The selection process and the announcement of the winner may, in the sole discretion of the producers, be filmed on such dates as may be determined by the producers and broadcast on the programme and/or on the website at any time. It is the responsibility of the entrant to inform the producers of any wheelchair or similar access requirements and to adhere to any applicable health and safety guidelines and other instructions.
Prize:
Winner - The finalist who has the highest number of eligible votes on the website will be the winner of the first prize (the “First Prize”).
By entering this competition, the winner grants the Prize Provider a licence for the Prize Provider to develop the winner’s original soup recipe with the objective of selling the finished soup in the Prize Provider’s stores. The winner hereby grants an exclusive, worldwide, licence to the Prize Provider to use, copy, adapt and/or modify the recipe and to produce the soup commercially and sell the soup in the Prize Provider’s stores in the United Kingdom and the Channel Islands until 24 May 2012. This licence will be royalty free which means no fee will be payable to the winner for this use. For clarity, this means that the winner cannot permit anyone else to produce the soup commercially.
The First Prize also includes a Waitrose Hamper worth £150 (one hundred and fifty pounds) which includes products to be determined by the Prize Provider in its sole discretion (the “Hamper”) and £1000 (one thousand pounds) worth of John Lewis Partnership vouchers (the “vouchers”) to spend in participating John Lewis department stores, Waitrose supermarkets, Waitrose Food and Home stores, Waitrose Direct Wines and online at www.johnlewis.com. The value of any monetary balance of the vouchers may not be exchanged for cash equivalent or alternative prize and they cannot be used to discharge indebtedness for an account or credit card or used to purchase financial products or services. There is no expiry date but the Promoter recommends that the winner redeems the vouchers within a year of receipt unless otherwise stated by the Prize Provider and/or the issuer of the vouchers. The vouchers are subject to additional terms and conditions and restrictions including but not limited to the following:
· Multiple vouchers may be redeemed in the same transaction up to the value of the goods being purchased.
· The full value of the vouchers does not have to be spent in one store visit.
· Some products may be excluded.
· Neither the Promoter nor the issuer of the voucher shall be liable where a voucher has been lost or stolen following delivery of the prize.
· The issuer of the voucher is responsible for the redemption of the vouchers.
Runner-Ups – The two (2) finalists who do not have the highest number of eligible votes on the website will be the winners of the runner-ups prize (the “Runner-Ups Prize”). The Runner-Ups Prize is a Hamper.
The First Prize and Runner-Ups Prize are non-transferable and no cash alternative is available. The Prize Provider reserves the right to award an alternative prize of equal or greater value, should the advertised prize or any part of it become unavailable for any reason.
General:
By making an entry and participating in this competition, you grant the Promoter permission to use the entry in any way it wants. This means that the Promoter can use, edit, reproduce, record, modify, translate, distribute, play, perform, broadcast, make available and display your entry and/or participation (or part thereof) and/or prepare derivative works of the entry and/or participation (without prejudice to any rights acquired by the Prize Provider) by any medium or method whether now known or later developed, including without limitation on the website or any other website in its sole discretion anywhere in the world. The Promoter may permit third parties to use the entry. You acknowledge that you will not receive any fee or royalty payment from the Promoter, the Prize Provider or any third party for the consents and grants given by you in relation to your entry and/or participation.
You confirm and agree that you are fully authorised and entitled to grant this permission. You agree to give us evidence of this authority and entitlement if requested by us. You agree to waive any moral rights that may exist in relation to your entry and/or participation. This means that you waive the right to complain about the way in which the Promoter, producers and/or Prize Provider may edit, alter or use your entry and/or participation and that the Promoter, producers and/or the Prize Provider do not have to identify you. You further waive any and all rights that you may have in respect of your entry and/or participation against the Promoter and the Prize Provider, including (but not limited to) any rights to take action against the Promoter or the Prize Provider for infringement of any intellectual property rights in such entry and/or participation.
You acknowledge and agree that if your entry results in you winning the prize, you will enter into any written arrangement which may be required by the Promoter or the Prize Provider to confirm your agreement to the foregoing as applicable, your consent to licensing any additional rights which may be retained when taking up the prize and/or your agreement to any additional contractual terms reasonably required by the Prize Provider.
The Promoter and/or the Prize Provider do not guarantee, represent, undertake or warrant that it will contact every entrant or broadcast or feature their entry and/or participation or otherwise exploit in any manner any content which may or may not include their entry and/or participation. Unless otherwise specified, the Promoter is not liable to refund any costs or expenses incurred in entering the competition including but not limited to internet access fees, any phone calls made, travel costs and accommodation, incidental costs, charges, fees, expenses and taxes.
By entering this competition you agree that the Promoter, the producers and the Prize Provider may use and store your personal details in the course of running the competition as set out in these terms and conditions and for related purposes such as promoting the competition, announcing and publicising the winner and advertising the Promoter’s, producers’ and Prize Provider’s products.
This competition and these terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English Courts.
