SPECSAVERS CRIME THRILLER AWARDS 2009 - ITV3 BESTSELLER DAGGER CATEGORY: VOTING TERMS AND CONDITIONS
General guidelines:
These vote guidelines are for votes made by phone or online. Please note that it is not possible to vote via any other method not specified here.
Viewers can vote for their favourite nominee from amongst a list of five (5) contenders that they want to win the ‘ITV3 Bestseller Dagger’ category within the Specsavers Crime Thriller Awards 2009.
Voting times:
Voting opens on 31 August 2009, and closes at 09:00 a.m. on Wednesday 21 October 2009. Voting times are liable to change and the producer of the programme may suspend, withdraw or re-set voting at its sole discretion at any time. The producer of the programme may in their sole discretion at any time change the rules for voting due to reasons beyond their control.
Voting restrictions:
You may vote up to 5 times by phone using the same phone number, or up to 5 times online where you provide the same email address. If you exceed this limit, or if your vote is made and/or received outside of the times specified, your vote will not be counted but you may still be charged where applicable.
ITV, its sub-contractors, subsidiaries and/or agencies are committed to operating viewer voting fairly and to preventing abuse of its systems. Hence, ITV and the producers of the programme reserve the right to discount votes if they have reasonable grounds to suspect, having regard to all circumstances and information available at the relevant time, that fraudulent voting has occurred, such that is designed to excessively manipulate the outcome of the vote or otherwise.
Voting via phone:
To register your vote for a nominee by phone, you may dial the numbers as stated in promotional information for the ITV3 Bestseller Dagger category. You will hear a short message thanking you for your vote.
Each phone vote will cost 35p from a BT landline. Calls from other networks may be higher and from mobiles will be considerably more. The total cost will be dependent on your network operator. Please ask permission from the bill payer before voting and please dial carefully and sensibly. There will be no refunds for the cost of any vote made or for any misdialled calls.
Anyone having difficulties getting through to the voting phone lines should wait and then try calling again during voting times only. The closing date and time to receive votes via phone is Wednesday, 21 October 2009 at 09:00 a.m. Votes received after this date and time will not be counted and may still be charged.
Voting online:
To vote for a nominee, you may go to the website at www.itv.com/crimethriller and follow the instructions given there to complete the online voting form and to provide a valid email address. An on-screen message will appear thanking you for your vote.
There is no charge for voting via the website, although internet service provider’s fees may apply. The closing date and time to receive votes via the website is Wednesday, 21 October 2009 at 09:00 a.m. Votes received after this date and time will not be counted.
Voting results:
The result of the vote will be from all votes submitted before the voting deadlines and received by the producer of the programme at the time when the result is calculated, after the deadline for receiving votes has passed. Please note that votes which have been sent but not yet received by the producer of the programme at the time when the result is calculated will not be counted.
The winning nominee from the five nominees will be announced on-air on 27 October 2009.
ITV will not have a say in the outcome of the vote. The nominee who has received the most votes will win the ITV3 Bestsellers Dagger category of the Specsavers Crime Thriller Awards 2009.In the event of a tie, where two or more nominees receive joint highest votes, or in the event that the outcome of the vote cannot be reasonably determined because of a technical failure or other circumstance beyond ITV’s reasonable control which affects the vote or any other decision which the vote would have determined, then a sealed vote by a panel of judges from the Film and TV industry will determine the outcome of the vote. Prior to the closing date and time, the panel of judges will be convened and vote for the winner of the ITV3 Bestsellers Dagger category. The result of their vote will be kept in a sealed envelope which will only be opened in the event of a tie, or if there is a failure in the mechanism of the public vote. The judges’ decision will be final.
ITV, the producer of the programme, their sub-contractors and/or agents do not accept any responsibility whatsoever for any technical failure, interruption or malfunction or any other problem with any telephone network or line, system, server, provider, software or otherwise which may result in any votes not being properly received, heard, registered or recorded, or for any votes incorrectly addressed, or lost in transit and we will not be held liable in any such event.
Nothing in these guidelines restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
