THE CUBE: APPLICATION TERMS & CONDITIONS
1. General guidelines
These terms and conditions relate to your application to participate in the television show entitled “The Cube” (Series 2) (the "Programme") which Objective Productions Limited (the “Production Company”) proposes but does not undertake to produce for ITV. The information given by you in your application may be used in the Programme should you be selected.
You acknowledge and agree to abide by these terms and conditions, and that these terms and conditions may be changed (including without limitation verbally) at any time by the Production Company and that you will be bound by such terms and conditions. The Production Company's decision shall be final.
2. Eligibility requirements
To be eligible to apply to participate in the Programme, you must meet the following eligibility criteria:
You must be a resident of the United Kingdom and be aged eighteen (18) years or over at the date of application. In addition, you must not be employed or have been previously employed or engaged by or be a live-in partner or immediate relative (i.e. mother, son, daughter, brother or sister) of an employee at the Production Company or the ITV Plc group of companies, or any of their subsidiaries and/or agencies associated with this competition.
By applying to participate in the Programme, you promise that you are eligible to apply, that the information you provide at the time of applying is correct, up to date, and is not misleading in any way, and you agree to be contacted by the Production Company, at their discretion.
3. Application procedure
Eligible applicants may apply to participate in the Programme by completing and submitting an application via the following method:

Send an email to us containing your name, date of birth, address, contact telephone number and a brief paragraph of why you want to be on the show along with a recent jpeg photograph of you to thecube@objectiveproductions.com . There is no charge when applying online, but your internet service provider’s fees may apply when accessing the internet.
The closing date for applications is 6 p.m. on 31 December 2009 but the Production Company reserves the right to extend the closing date at their sole discretion.
By applying you signify your acceptance of these terms and conditions, and to any terms and conditions provided during the application process.
You may not apply via any method not specified here and applications on behalf of another person are void. You must comply with any stated deadline for applying. Applicants must provide all the required information honestly and truthfully. The Production Company cannot acknowledge receipt of any application or return any photographs or other submitted content. Applicants may only apply once for this series and any duplicate applications will be invalid and will not be considered.
Applications which are sent and/or received by the Production Company after the stated deadline or which are false, misleading, incomplete, incomprehensible, incorrectly addressed, lost in transit or not received are invalid and will not be considered. The Production Company reserves the right in its sole discretion to invalidate any application received. The Production Company cannot accept responsibility for any application which is not received by the stated deadline.
The Production Company and/or ITV will only pass an applicant’s data to third parties for marketing purposes if that applicant has asked to receive marketing information from those third parties. Any information and other data which is provided by you when you apply will be held and used by the Production Company, ITV and their sub-contractors in order to administer your application and for the production and promotion of the Programme. This may include but is not limited to the Production Company using the information you provide to verify your age and identity and to carry out background checks with law enforcement and government agencies. All submitted material in your application are considered as “Submissions” (as defined under the Terms of Use at www.itv.com/terms) and are subject to such Terms of Use.
4. Selection procedure
The Production Company reserves the right to contact any applicant on the phone number and/or email address as indicated in their application and/or to raise further questions and queries in respect of the application at their discretion. The Production Company does not guarantee that all applicants will be considered and/or contacted. If an applicant cannot be contacted, or is not eligible and/or does not comply with these terms and conditions as specified, then the Production Company reserves the right to invalidate the application. The decision of the Production Company is final.
If your application is successful you may be invited to attend an audition at a time and place to be notified by the Production Company. The Production Company cannot guarantee that you will be offered an audition. If applicable, following the auditions applicants will be selected to take part in the Programme at the sole discretion of the Production Company whose decision will be final. The Production Company cannot guarantee that unsuccessful applicants either at application stage or after the audition stage, if applicable, will be contacted.
If you are invited to attend an audition you hereby grant all consents necessary for the Production Company to film and record such audition and to use recordings featuring your image and/or voice in connection with the Programme and/or ancillary rights in the Programme and to exploit the same in all media throughout the world in perpetuity without the need for payment to you.
If your application is successful, it is your responsibility to ensure that you are available at any times specified and to attend the location of the audition and/or filming of the Programme if applicable. It is your responsibility to bring valid proof of age and eligibility and to make your own way to such specified location, unless otherwise stated. You will be required to comply with any directions and/or instructions given to you, including, without limitation, in regard to conformity with the Ofcom Broadcasting Code, health and safety instructions and all relevant laws, rules and regulations. Failure to provide valid proof of age and eligibility or to comply with any directions or regulations will result in you no longer being permitted to proceed further.
You will not, without the Production Company’s prior written consent, disclose, publish or discuss with any third party any information relating to the selection process, the Programme, your appearance in the Programme, the production team or any participants in the Programme or any other information which may come to your attention including without limitation any information relating to ITV, the Production Company or otherwise save where such information is already in the public domain.
Should you be selected to take part in the Programme you may be required to enter into further contracts with the Production Company and agree to abide by the terms therein and agree that failure to do so may result in you being withdrawn from the application process and forfeiting all rights as a participant without further notice.
Neither the Production Company nor ITV is liable to refund any costs or expenses incurred in applying, or in participating in the Programme, including but not limited to the cost of calls made, internet access fees, travelling expenses, transportation, accommodation, meals, drinks, insurance, taxes and costs unless otherwise provided for.
5. General rules
The Production Company, ITV and their sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any network, system, server, software provider or otherwise which may result in any application not being properly received or recorded.
The Production Company and/or ITV cannot promise that the system and/or service will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The system and/or service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of the Production Company or ITV. Neither the Production Company nor ITV will be liable to you or to any other person in the event that all or any part of the system and/or service is discontinued, modified or changed in any way.
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
6. Queries/Complaints
If you have a query or complaint about your application, you may register it with ITV Viewer Services who can be contacted by phone on 0844 88 14150, or by email at viewerservices@itv.com. You will need to give the following information:
(a) Your Name
(b) Confirmation of the email or postal address you have been applying through
(c) Where applicable, the IP number of your computer and your internet service provider
(d) The nature of your query or complaint
(e) A contact telephone number you can be reached on
