X FACTOR COMPETITION
Competition entry question:
Eligible entrants are required to follow the instructions given and to answer the question correctly as stated in the “X Factor” and/or the “Xtra Factor” (the ‘programme’). Eligible entrants will be entered into a draw to win the competition prize (the “prize”) and the prize-draw prize (the “prize-draw prize”) (together, the “prizes”), as detailed below.
Opening/closing date & time:
· Competition opens for entries via PRTS, SMS, red button and online as stated in the programme.
· Competition closes for entries via PRTS, SMS and red button at 6:30 p.m. on Saturday 31 October 2009. Entries after the closing time will not be entered into the competition but may still be charged.
· Entry via the www.itv.com website is open for at least three (3) working days after the programme.
Draw date: within 24 hours of the closing date and time for all entries.
Method & cost of entry:
· PRTS - call 090 49 59 69 79; up to 5 entries per phone number. Each call costs £1.00 from BT landlines. Calls from other networks may be higher and from mobiles will be considerably more.
· SMS – send text to 84066 with your answer; up to 5 entries per phone number. Each text costs £1.00 plus one standard network rate message.
· Red button – Virgin Media and Sky digital satellite viewers press the red button on their remote control; up to 5 entries per phone number. Each red button entry costs £1.00.
· Online – go to www.itv.com and follow instructions; up to 5 entries per phone number. There is no charge for online entries.
There is no email or postal entry available. Entries on behalf of another person are void. Entries over the maximum number of entries for each method of entry, or entries made or received by the Promoter after the closing time will not be entered into the competition but may still be charged. Entries which are incomplete, inaudible, incomprehensible, or not received by the Promoter are void but may still be charged. The Promoter’s decision is final.
Competition prize:The first correct entry drawn at random from all eligible entries will win the prize. The prize is a Flat Screen TV, an iPod touch, an Xbox Elite, an electronic book reader, an espresso machine, a Flip video camera and iTunes vouchers for a value of £100 (the ‘vouchers’). Each voucher is worth £25. The prize also includes a pair of tickets to the recording of the X Factor show on either 7 or 8 November 2009 at Fountain Studios, Wembley (with the exact date to be decided at the programme maker’s discretion).
The Promoter and/or prize provider may in its sole discretion vary any element of the prize due to reasons beyond the Promoter’s reasonable control, including but not limited to the unavailability of the website for one or more working days before the competition closing date. If the Promoter and/or prize provider exercises this discretion and varies the element of the prize relating to the tickets to the X Factor show, the Promoter and/or prize provider expects, but does not guarantee that the revised element of the prize may be taken up on an alternative date during the dates when the X Factor shows are taking place in 2009, subject to availability, confirmation and any other applicable restrictions. For the avoidance of doubt, the Promoter and/or prize provider will not be liable in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way. The vouchers will be subject to additional terms and conditions including but not limited to: the vouchers are only redeemable on the iTunes store and expire two years from the date of issue, vouchers cannot be redeemed for cash, returned for cash refund or used to purchase any other merchandise or provide monthly gifts or iTunes Gifting. Neither the provider nor the Promoter shall be liable where vouchers have been lost or stolen following delivery of the prize. The prize provider reserves the right to refuse to accept or otherwise permit vouchers to be used which it deems to be invalid, or which it deems to have been tampered with, defaced, duplicated, damaged or otherwise suspected to be affected by fraud.
The prize is subject to restrictions including but not limited to programme scheduling and travel and access restrictions and to the terms of the manufacturer and/or prize providers. The winner must follow instructions given by the Promoter and/or prize providers to take up the prize. There is no cash equivalent or alternative prize. The prize is non-changeable and non-transferable. The prize providers will endeavour to confirm arrangements for collection and/or delivery of the show tickets within 48 hours of winner confirmation i.e. the date that the winner has been contacted and their eligibility has been confirmed. The prize providers will use reasonable efforts to deliver the Flat Screen TV, iPod touch, iTunes vouchers, Xbox Elite, electronic book reader, an espresso machine and Flip video camera within 28 days of winner confirmation.
Prize-draw prize: Entrants for the prize will be entered into the prize-draw. The first correct entry drawn at random from all eligible entries will win £50,000 (fifty thousand pound sterling) payable by cheque to in the name of the entrant only, and deliverable within 28 days of winner confirmation. The prize-draw prize is non-changeable and non-transferable and it excludes taxes, charges, fees and any additional costs and expenses. There is no alternative prize-draw prize. The prize-draw date will take place no later than Friday 18 December 2009. The winner will be contacted as soon as practicable on or after the prize-draw date on the phone number they provided when entering the competition.
General: The winner must be aged 18 or over at the time of entering the competition, and may be required to provide proof of age and eligibility. The winner’s companion must be aged 16 or over and must have prior parental permission to attend the show if aged 16 or 17. Proof of age and eligibility may be required. For the avoidance of doubt, the prizes exclude other costs and expenses including but not limited to installation costs, accommodation costs, travel expenses, souvenirs, supplementary products and accessories, taxes and any other costs. To the fullest extent permitted by law, the Promoter is not liable for any costs, liabilities, damages, losses or medical conditions aggravated or incurred by the winner and/or companion in taking up the prizes. The Promoter will only pass an entrant’s data to third parties for marketing purposes if the entrant has asked to receive marketing information from those third parties. Contact information provided will not be amended once entry to the competition has been made. All reasonable efforts will be used to contact the winner on the competition draw date. The winner of the prize will be contacted on the phone number they provided, calling three times in a two-hour period. If successful contact is not made for the prizes, or if they fail to provide an address for delivery, or fail to meet the eligibility requirements as set out in the general competition terms and conditions and elsewhere as applicable, or are otherwise unable to comply with these terms and conditions and take up the prizes as specified, this may result in forfeiture of the prizes and the Promoter reserves the right to offer the prizes to the next correct entry drawn at random from all eligible entries and thereafter until a winner is found.
