COMPETITION INFORMATION: X FACTOR SMS BOUNCEBACK COMPETITION
Opening/Closing date & time:
· Competition opens for entries by WAP via the ITV Mobile portal at http://itv.mobi/xfactor (the “WAP Portal”) and online on 3 October 2009.
· Competition closes for entries via the WAP Portal on 6 December 2009 at 23:59 p.m. Entries made after the closing time will not be entered into the competition but may still be charged.
· Entry via the www.itv.com website (the “Website”) is open for at least 3 working days after the lines have closed.
Method of entry:
· WAP Portal - Eligible entrants are required to click on the link to this competition on the WAP Portal and follow the instructions given. Where indicated, entrants must enter A, B or C to indicate their answer to the question. Eligible entrants must include the required information. The winner will be identified by the mobile phone number from which they access the WAP Portal. Information provided via the WAP Portal on how to enter the competition and on the prizes form part of these Terms and Conditions. Up to ten entries per phone number.
· Online entry – Go to the Website and follow instructions. Eligible entrantsare required to enter personal details including their name and telephone number. Where indicated entrants must enter A, B or C to indicate their answer to the question. Up to ten entries per phone number.
Entrants who answer the question and complete the entry requirements will be entered into a draw to win the prize. There is no entry via SMS, email, post, red button or any other method of entry not stated in these terms and conditions. Entries on behalf of another person are void. Entries over the maximum number of entries for each method of entry, or entries made or received by the Promoter after the closing date and time, or entries which are incomplete, misspelt, inaudible, incomprehensible, or not received are void and will not be entered into the competition but may still be charged.
Cost of entry:
· WAP entry - Each entry via the WAP Portal costs £1. Mobile network operators may also charge their customers for using the mobile internet/browsing tools. Entrants should contact their network operator for more details, as these charges may vary depending on the entrant’s mobile network operator and tariff. The cost of entry will appear on the telephone bill of the mobile phone used or will be deducted from available funds for pay-as-you-go mobile phones. Entrants must have the permission of the bill payer before entering.
· Online - There is no charge for entries made via the ITV website.
Competition draw date: Within 24 hours of the closing date and time for all entries.
Prize:
The first correct entry drawn at random from all eligible entries will be the winner of the prize. The prize is a pair of tickets to the X Factor Live Final taking place at Fountain Studios, Wembley on Saturday, 12 December 2009. The prize is subject to the terms and conditions of the prize provider. It is the responsibility of the winner to ensure they and their companion are available to take up the prize as specified on the relevant dates. It is the responsibility of the winner to make their own way to the event. The prize is subject to availability and restrictions including but not limited to inclement weather conditions, travel and access restrictions, programme scheduling and other circumstances beyond the reasonable control of the Promoter and/or prize provider. The winner must follow instructions given by the Promoter and/or prize provider to take up the prize including but not limited to collection of tickets if applicable. The Promoter reserves the right to amend any element of the prize for reasons beyond their reasonable control. The prize is non-changeable, non-transferable and non-upgradeable. There is no cash equivalent or alternative prize. To the fullest extent permitted by law, the Promoter is not liable for any costs, liabilities, damages or losses or for any medical conditions aggravated or incurred by the winner and/or their companions in taking up the prize. For the avoidance of doubt, the prize excludes all other costs including but not limited to accommodation, transportation, travelling expenses, parking costs, hotel charges, telephone calls, souvenirs, incidental costs, taxes and any insurance. Employees of the prize provider and their immediate families are ineligible to enter this competition. Other restrictions may apply. The winner must be aged 18 years or over at the time of entering the competition, and their companion must be aged 16 or over. The winner and their companion may be required to confirm proof of age and eligibility. The Promoter endeavours to make available for collection tickets on arrival by the winner at Fountain Studios, Wembley on Saturday, 12 December 2009. The winner may be required to participate in publicity. The Promoter will only pass an entrant’s data to third parties for marketing purposes if that entrant has asked to receive marketing information from those third parties.
The Promoter will not amend contact information provided once entry to the prize draw has been made. The Promoter will use all reasonable endeavours to notify the winner on the draw date. He/she will be contacted on the daytime phone number they provided when entering the prize draw, calling three times in a two-hour daytime period. If successful contact is not made, or if they fail to provide an address for delivery, or fail to meet the eligibility requirements as set out in the general competition terms and conditions, and elsewhere as applicable, or are otherwise unable to comply with these terms and conditions and take up the prize as specified, this may result in forfeiture of the prize and the Promoter reserves the right to offer the prize to the next entrant drawn at random from all eligible entries and thereafter until a winner is found.
