X FACTOR VOTING GUIDELINES
 
1.         General Voting Guidelines
 
Votes are only open to individuals as consumers and votes are not open to any agencies, businesses and/or companies.Votes are only open to UK and Channel Islands residents.
 
You may vote by phone or red button for which contestant you want to keep in the competition, as specified in the X Factor programme (the ‘Programme’). Please note it is not possible to vote via SMS, the internet or via email.
 
Vote lines are opened and closed as specified in the Programme. Votes made or received outside of these specified times will not be counted but may still be charged. Voting times are liable to change and ITV may suspend, withdraw or re-set voting at its sole discretion at any time. ITV may in its sole discretion at any time change the rules for voting.
 
The result of the vote will be established from all votes received by the producer of the Programme at the time when the result is calculated, after the lines have closed. Please note that votes which have not been received by the producer of the Programme at the time when the result is calculated will not be counted but may still be charged.
 
2.         Voting - Method and Cost
 
Red Button – Sky and Virgin Media users press the red button on their remote and follow instructions. Each Red Button vote costs 35p.
 
Phone - dial the premium rate telephone number for your chosen contestant as displayed in the Programme.
 
Each phone vote costs 35p (35 pence) from a BT landline. Calls from other networks may be higher and from mobiles will be considerably more. The total cost will be dependent on your network operator. Permission of the bill payer must be sought before voting. Please dial carefully. There will be no refund for the cost of any misdialled calls.
 
ITV is committed to operating viewer voting fairly and to preventing abuse of its systems, as well as those of its agents and sub-contractors. Hence, ITV and the producers of the Programme reserve the right to discount votes if they have reasonable grounds to suspect, at their sole discretion, that (a) fraudulent voting has occurred, such that is designed to excessively manipulate the outcome of the vote; or (b) votes have been made in breach of these terms and conditions.
 
While you may vote as many times as you like, ITV believes that any votes, which are received from any one recognised number in excess of 1000 for one contestant, are deemed to be designed to excessively manipulate the outcome of the vote and are unfair to other users and other contestants. Therefore if you vote more than 1000 times for one contestant from any one platform, ITV and the Programme producers reserve the right to disqualify any votes made above that number, having regard to all the circumstances and information available at the relevant time.
 
Voting is intended for viewers watching the show in the UK. Responsibility cannot be accepted for any vote services promoted outside the UK as these are not within our control and ITV and the Programme producers reserve the right to discount votes if they reasonably consider them to have been made from outside the UK. 
 
ITV and the Programme producers are committed to operating a fair and consistent voting system.  Please note that ITV and the Programme producers are unable to confirm the integrity of any other voting method except for the official voting system and numbers promoted and displayed within the Programme.
 
Anyone having difficulties getting through to the voting lines should wait and then try calling again within voting times only.
 
ITV, the producers of the Programme, their agents and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider, software or otherwise which may result in any vote being lost or not properly received, registered or recorded.
 
ITV cannot promise that the red button service or phone lines will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. The system and/or service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of ITV, their agents and sub-contractors, and will not be liable to you or to any other person in the event that all or any part of the system and/or service is discontinued, modified or changed in any way.
 
ITV will not have a say in the outcome of the vote. In the event of a tie or if the outcome of a vote cannot be reasonably determined because of a technical failure or other circumstance beyond the reasonable control of ITV, the producer of the Programme, their agents or sub-contractors, then the judges’ decision will determine which contestant stays or leaves the competition or any other decision which the vote would have determined. The judges’ decision will be final.
 
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
 
3.         Queries/Complaints
 
If you have a query about voting, you may register your query with the ITV duty office who can be contacted by phone on 0844 88 14150 or by email at viewerservices@itv.com. You will need to provide the following information:
 
1. Your Name
2. The telephone number of the phone you called from
3. The time(s) you called when you experienced problems
4. If possible, your telephone network operator, e.g. BT, Virgin Media, etc
5. A contact telephone number if different from number 2 above
6. Confirmation of the number that you have been dialling
7. The name of the region/town in the UK you are calling from if calling from a mobile phone
8. The nature of the problem you have experienced when calling
