PROGRAMME INTERACTIVE TERM AND CONDITIONS

1. General guidelines

These terms and conditions apply to any ITV interactive service which invites you to interact with a programme on ITV (the “programme”) via any stated methods or media, including without limitation where you respond by submitting comment(s) or content (“content”) which may include but is not limited to photograph(s), video, audio, live-media images, drawings and/or other similar designs (the “interactive service”). References to “contribution(s)” in these terms and conditions includes content and/or other participation in the interactive service as applicable.

These terms and conditions may be amended or varied at any time without prior notice. Any changes will be posted on the website at www.itv.com. It is your responsibility to ensure you review these terms and conditions regularly to familiarise yourself with any changes. ITV recommends that you print and store or save a copy of these terms and conditions for future reference.

2. Eligibility

You must be a UK resident aged 18 or over to participate in the interactive service unless otherwise permitted. Where it is permitted in ITV’s discretion, if you are under 18 years old, you must have parental or legal guardian permission before participating in the interactive service and ITV reserves the right to contact your parent or legal guardian to verify such prior permission. If you are under 18 years old and are required to participate on the programme in person and/or interact with the programme via live-media, you must be accompanied by a parent or legal guardian (although ITV does not guarantee that your parent or guardian will be featured in the programme). If ITV suspects that you are not eligible to participate in the interactive service, ITV reserve the right to terminate or suspend your participation in the interactive service.

ITV may require you to provide proof of age and eligibility, and you may further be required by ITV and/or authorized parties to provide your signature as proof of your agreement to any relevant waivers, releases and/or consent. Failure to provide valid and current proof of age and/or eligibility, or to provide your signature as required may result in your contribution no longer being considered.

You may participate in the interactive service as many times as you wish, unless otherwise stated in the promotional information for the interactive service.

ITV will not return any content sent in to the interactive service, unless otherwise stated. It is recommended that you send in copies rather than original material.

3. Method and cost of participation

Availability times: You may participate in the interactive service by following the instructions indicated during the dates and times as stated in the promotional information for the interactive service.

Method: You may participate in the interactive service via the media and/or method(s) as stated in the promotional information for the interactive service which may include but are not limited to phone, SMS or MMS text messaging, email, online, red-button application, live-media, post, third-party sites or services including without limitation social media networks or any other specified method(s) or media. You should comply with any restrictions specified in the promotional information for the interactive service including without limitation submitting contribution(s) in a stated media or format. Failure to comply with such restrictions may mean that your contribution(s) may not be considered but you may still incur charges where applicable. Please note that your use of any third-party sites or services is subject to their terms of use and privacy policy. You agree that it is your responsibility to have available the technology, network connection and/or software required as stated in the promotional information for the interactive service.

You may not participate in the interactive service via any other media and/or method(s) not specified in the promotional information for the interactive service, or outside of the relevant date(s) and time(s). Contribution(s) made via other media and/or method(s) or outside of the stated date(s) and time(s) will not be considered or included in the programme, and you may incur charges.

ITV, the producers of the programme and their sub-contractors bear no responsibility for any contribution which is incorrectly addressed, lost in transit, or damaged or interrupted in any way. Contributions sent in by post are deemed received upon arrival. ITV is not responsible for any irregularities, industrial action or disruption affective any delivery method and ITV will not be held liable in any such event.

Required information: You may be required to provide personal contact information and other details when participating in the interactive service including without limitation your name and mobile/daytime contact telephone number. Failure to include the required information may result in your participation in the interactive service not being considered but you may incur charges where applicable.

Cost: Any applicable charges for participating in the interactive service are as indicated in the relevant promotional information for the interactive service. Permission of the bill payer must be sought before participating in the interactive service. There will be no refunds for the cost of participating in the interactive service. There is no charge when participating in the interactive service via email, freephone number(s), post or via the internet unless otherwise stated. Internet service provider’s fees may apply when you access the internet and sufficient postage must be paid.

4. General terms

By submitting contribution(s) to the interactive service, you agree that ITV and/or authorized third parties may contact you in connection with the programme and/or interactive service and/or for participation in a programme.

ITV does not guarantee that all persons who submitted a contribution to the interactive service will be contacted. ITV does not guarantee, represent, undertake or warrant that it will broadcast on-air or in any other media the programme or include your participation in the interactive service in any future episode of the programme, or that your contribution(s) will be considered or will otherwise be used in whole or in part despite being received by us, even if you have received an acknowledgment of sent and/or receipt message.

You acknowledge and agree that ITV may in their sole discretion include your contribution and your personal details in the programme and/or in any future episode of the programme, on website(s) including without limitation on www.itv.com or in any other media in connection with the programme and/or to broadcast or otherwise make it public via any media or otherwise exploit it in any manner without notice and without any fee being paid.

ITV and/or authorized third parties may modify any contribution(s), or may accept it, or refuse to consider it in their sole and absolute discretion. You agree that all or part of your contribution including your personal details may be edited, adapted, displayed or published in all media and/or otherwise made publicly available in the discretion of ITV and/or authorized parties. If ITV, in their sole discretion, deems it necessary to do so it may disguise and/or conceal the identity of a participant in the interactive service. If you make contribution(s) via methods or media which are available to the public, ITV recommends that you do not disclose personal contact information including but not limited to addresses or phone numbers.

All contributions are considered as “Submissions” (as defined under the Terms of Use at www.itv.com/terms) and are subject to such Terms of Use. When you participate in the interactive service, your contribution(s) may be moderated and will be subject to the restrictions and guidelines including without limitation the following: You should not make contribution(s) containing any material which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. You agree not to advertise or promote third parties' or your own goods or services including by way of the distribution of "spam". Any such contribution(s) may be deemed unsuitable and not accepted. You promise that you will not submit any contribution which in any way infringes any applicable laws or infringes the rights of a third party (such as any Submission which contains third party content such as music, third party trademarks, logos, insignia, location signage, photographs, artwork, or sculpture).

ITV reserves the right to vary any element of the interactive service and/or to suspend or discontinue the interactive service without notice, due to system failure, maintenance or repair or for reasons beyond the reasonable control of ITV including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with a law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. ITV will not be liable to you or to any other person in the event that all or any part of the interactive service and/or system is discontinued, suspended, modified or changed in any way.

ITV cannot promise that the interactive service and/or system will be free from errors or omissions, nor that it will be available uninterrupted and in a fully operating condition. ITV does not accept any responsibility whatsoever for any technical failure or malfunction or any other problem including without limitation with any telecommunications network or line, system, delivery system or technology, software, server, service, provider which may result in any contribution being lost or not properly received, registered, heard or recorded. ITV may suspend, withdraw or re-set the interactive service in its sole discretion at any time.

Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.

5. Privacy

Information and data ("personal data") which is provided by you when you participate in the interactive service will be held and used by ITV, the ITV group of companies and/or the producer of the programme (if applicable), their service providers, network operators, suppliers and contractors in connection with your participation in the interactive service and the programme where applicable.

ITV will only pass your data to third parties for marketing purposes if you have accepted to receive marketing information from those third parties.

If you participate in the interactive service by SMS and/or MMS, you may opt out of receiving any marketing communications from ITV by adding the word NOINFO. At any time, you can amend your marketing preferences and opt-out of receiving any marketing communications from ITV by sending an email to itvihelp@itv.com or calling 0844 88 14150 and giving your name and email address.
