THE VOICE KIDS UK SERIES 3 VOTE: VOTING INTERACTION INFORMATION

Voting method and cost:

Viewers in the UK, Isle of Man and Channel Islands may vote for which contestant(s) they wish to win the competition as specified in ‘The Voice Kids UK Series 3’ programme (the “programme”) by one of the following methods:

· Phone: Dial the premium rate‘09’ number as stated in the programme and follow instructions. You will hear a short message thanking you for your vote. Each phone vote costs 50 pence plus your network access charge. The total cost will be dependent on your network operator. Viewers can find out more information about the amount that their mobile operator will charge them by visiting http://www.accesscharge.uk/; but the Promoter and producers of the programme recommend that for the most up to date charges viewers enquire directly with their mobile network operator.

· Mobile short dial codes (“MSDC”) (also known as voice short code): UK mobile users dial the number which is the MSDC for the chosen contestant as displayed in the programme and listen to the recorded message which confirms the MSDC vote. Each vote via a UK mobile to a MSDC costs 50 pence. MSDC voting is only available from a mobile phone. It is not possible to vote by calling the MSDCs from a landline or via any other method. Call charges may apply if the number is mis-dialled but is a valid number. The Promoter gives no warranty that the MSDC service will be available, legal or appropriate for use in locations outside the UK.

15 pence from each vote goes to Make-A-Wish® UK(charity registered in England and Wales under registration number 295672, and registered in Scotland under registration number SC037479. Registered office is329-331 London Road, Camberley, Surrey, GU115 3HQ).

If there are technical or other issues with the PRTS or MSDC votes, the Promoter reserves the right to discount the PRTS or MSDC votes (as applicable) and announce the result of the vote without including those affected votes.

The Promoter is unable to confirm the integrity of and is not responsible for any vote services promoted outside the UK, Channel Islands and Isle of Man or for any unofficial voting methods as these are not within their control. Votes must not be sent in through agents or on behalf of another person, and viewers cannot submit votes as an agent of any other person. The Promoter and the programme producers reserve the right to discount votes if they have reasonable grounds to suspect they have been made from outside the UK, Channel Islands and Isle of Man, from unofficial third party voting services or otherwise in breach of any applicable terms and conditions.

If for any reason there is a discrepancy between the numbers advertised on air and those given on any other platforms, then the numbers on air will prevail and the vote shall proceed on that basis.

Please note it is not possible to vote via any method not stated in these terms and conditions.

Opening/closing times:

Vote lines are opened and closed on Saturday 27July 2019 as specified in the programme.

Voting restrictions:

While you may vote as many times as you like, the Promoter believes that any votes for one contestant, which are received from any one recognised number in excess of six hundred (600) votes, are deemed to be designed to excessively manipulate the outcome of the vote and are unfair to other users and other contestants. Therefore, if you vote for one contestant more than six hundred (600) times from any one platform, the Promoter and the programme producers reserve the right to disqualify any votes made above that number, having regard to all the circumstances and information available at the relevant time. The Promoter and/or the Programme producers may in their sole discretion contact voters who have voted in excess of the permitted levels.

Voting results:

The outcome of the vote will be shown in the programme. The four (4) finalists will perform and the contestant with the most votes will be announced the winner of the competition.

Contingencies

In the event of a tie in the public vote, the joint winners will share the prize between them.

If any of the contestant(s) are unable to perform or are prevented from performing fully in the programme for any reason including without limitation medical reasons, that contestant may at the producer's discretion be given another opportunity to perform taking into account the circumstances at the time, having regard to all circumstances and information available to them at the relevant time. The producers of the programme will in their sole discretion determine if another contestant may be allowed to enter the competition.

In the event that any of the contestant(s)withdraw from the competition either due to illness or other reasons then the programme will continue with one person less.

If illness / nerves / injury prevent any of the contestant(s) from performing in the final or interrupts their performance, that contestant may at the producer’s discretion be given another opportunity to perform taking into account the circumstances at the time. If that contestant is unable to perform, that contestant shall withdraw from the programme. If the contestant has already performed/part performed they can still be judged and voted for.

If the outcome of a vote cannot be reasonable determined because of a technical failure or for any other reasons beyond the programme producer’s or ITV’s reasonable control, the result will be announced or the vote will be run on the programme This Morning the following Monday.

If for any reason there is a discrepancy between the numbers advertised on air and those given on any other platforms, then the numbers on air will prevail and the vote shall proceed on that basis.

Please note it is not possible to vote via any method not stated in these terms and conditions. The Promoter may, at its sole discretion, withdraw app voting on a temporary or permanent basis.

Opening/closing times:

Voting opens and closes for each voting event as specified on the app, on authorised social media and/or during the Programme.

Voting restrictions:

Users of the app are limited to one (1) vote per voting event on each eligible mobile device, save that where a voting event is open for longer than a day (e.g. Sunday to Monday), users of the app will be limited to one (1) vote per day of the voting event, or two (2) votes per day when the voting event is the Final Love Island Live Show. Users can have a maximum of six (6) devices linked to each Apple or Google account. Any additional mobile device will not be eligible to vote.

Eliminations

At various points in the Programme, at the discretion of the Promoter or the Programme producers, there will be a voting event where viewers may vote on which Islander(s) they wish to keep in the competition or which Islander(s) they wish to be eliminated from the competition. In the case of votes to keep Islanders in the competition, the Islander(s) with the lowest number of votes will be eliminated from the competition. In the case of votes to eliminate Islanders from the competition, the Islander(s) with the highest number of votes will be eliminated from the competition. In each case, the elimination format, and any specific terms relating to that particular elimination, will be announced in the applicable on-air interaction information, on authorised social media and/or within the app before voting opens.

The producers of the Programme may in their discretion reintroduce an Islander seen in earlier stages of the competition who was previously evicted. The Programme producers' decision will be final.

Voting results:

The outcome of a voting event will be shown on the app, on authorised social media and/or during the Programme.

During the final episode of the Programme, the couple with the most valid votes will be declared the winners of the competition.

Contingencies

If any of the Islander(s) leave or are removed from the Programme for any reason, including without limitation medical reasons, then the producers of the Programme will in their sole discretion decide whether such Islander(s) will be removed from the vote or the vote may be cancelled and restarted without such Islander(s), having regard to all circumstances and information available to them at the relevant time. The producers of the Programme will in their sole discretion determine if another Islander may be allowed to enter the competition.

If the outcome of a vote cannot be reasonably determined because of a technical failure, a tie, or for any other circumstance beyond the reasonable control of the Promoter, the producers of the Programme, their agents or sub-contractors, then the Promoter and Programme producers may choose (at their sole discretion) that the vote will be cancelled and reopened at a later date; or that the Programme producers will determine the outcome; or that the other Islanders will determine the outcome.

Any decision by the Islanders, the Promoter or the producers of the Programme will be final.

If a voting event is cancelled, then at the Promoter’s and Programme producers’ discretion either the Islander(s) will decide on the outcome of that voting event, or the voting event will be postponed. Any decision by the Islanders, or by the Promoter and Programme producers will be final.

Alternative voting route

Without limiting the above, if there are technical or other issues with the in-app vote, or other circumstance then (at the Promoter’s and Programme producers’ discretion) the voting mechanic may be changed to a paid emergency mobile voice short codes (“MVSC”) for the Final Love Island Live Show. This will involve calling the following 7 (seven) digit number 6505101-20 from a UK mobile telephone which confirms the MVSC vote. Each vote via a UK mobile to a MVSC costs 35 pence. MVSC voting is only available from a mobile phone. It is not possible to vote by calling the MVSC from a landline or via any other method. Call charges may apply if the number mis-dialled is a valid number. The Promoter gives no warranty that the MVSC service will be available, legal or appropriate for use in locations outside the UK.

Viewers voting via MVSC may vote as many times as they like, however the Promoter and the producers of the Programme believe that any votes for one voting event which are received from any one (1) recognised number in excess of six hundred (600) votes are deemed to be designed to manipulate the outcome of the vote and are unfair to other users and other Islanders. On the MVSC platforms (where it is not technically practical to limit the votes) if a viewer votes more than 600 times in respect of one voting event, the Promoter and the Programme producers reserve the right in their sole discretion to disqualify any votes made above the permitted levels having regard to all the circumstances and information available at the relevant time. The Promoter and/or the Programme producers may in their sole discretion contact voters who have voted through the MVSC platforms to an excessive level.

All viewers voting must obtain the bill payer’s permission before voting.
