CHANNEL ISLANDS SPORTS PERSONALITY OF THE YEAR 2019 VOTE: VOTING INTERACTION INFORMATION

Voting method and cost:

Viewers may vote for which Channel Islands sports personality they would like to win the award of ‘Channel Islands SportsPersonality of the Year 2019’ as specified in the ‘Channel Islands SportsAwards 2019’ programme (the “Programme”) by the following method:

· Phone: Dial the number as stated in the promotional information and follow instructions. You will hear a short message thanking you for your vote. Each phone vote costs 5 pence PRTS -plus your network access charge. The total cost will be dependent on your network operator. The Promoter and producers of the Programme recommend that for the most up to date access charges viewers enquire directly with their network operator.

If there are technical or other issues with the votes, the Promoter reserves the right to discount the votes (as applicable)and announce the result of the vote without including those affected votes.

The Promoter is unable to confirm the integrity of and is not responsible for any vote services promoted outside the ChannelIslands or for any unofficial voting methods as these are not within their control. Votes must not be sent in through agents or on behalf of another person, and viewers cannot submit votes as an agent of any other person. The Promoter and the Programme’s producers reserve the right to discount votes if they have reasonable grounds to suspect they have been made from unofficial third party voting services or otherwise in breach of any applicable terms and conditions.

If for any reason there is a discrepancy between the numbers advertised on air and those given on any other platforms then the numbers on air will prevail and the vote shall proceed on that basis.

Please note it is not possible to vote via any method not stated in these terms and conditions.

Opening/closing times:

Voting opens at 6:00 p.m. on Tuesday 7 January 2020 and closes at 9:00 p.m. on Thursday 30 January 2020.

Voting restrictions:

You may vote up to five (5) times using the same phone number. If you exceed this limit your vote will not be counted but you may still be charged where applicable.

Voting results:

During the final awards show of the Programme, to be held on 30 January 2020, the contestant with the most votes will be declared the winner of the competition.

In the event of a tie, the tied winning finalists will share the award.

Any variation on the format of elimination asset out in these terms and conditions will be announced in the Programme and such format as announced in the Programme will prevail.

Contingencies:

If the final outcome of the vote cannot be reasonably determined because of a technical failure or other circumstances beyond the reasonable control of the Promoter, the producer of the Programme, their agents or sub-contractors, then the Promoter will use the latest available voting statistics to determine the winner. In the event that no voting statistics are available, a panel of judges consisting of individuals who have experience of working within the sports industry (including an independent judge) (the “Panel”) will determine the winner and the Panel’s decision will be final.

THE X FACTOR: THE BAND 2019 VOTE: UK VOTING INTERACTION INFORMATION

Voting method and cost:

Viewers in the UK, Isle of Man and Channel Islands may vote for their favourite band as specified in The X Factor: The Band programme (the “programme”) by one of the following methods:

· Phone: Dial the premium rate ‘09’ number as stated in the programme and follow instructions. You will hear a short message thanking you for your vote. Each phone vote costs 35 pence plus your network access charge. The total cost will be dependent on your network operator. The Promoter and producers of the programme recommend that for the most up to date charges viewers enquire directly with their mobile network operator.

· Mobile shortdial codes (“MSDC”) (also known as voice short code): UK mobile users dial the 7-digit number which is the MSDC for the chosen band as displayed in the programme and listen to the recorded message which confirms the MSDC vote. Each vote via a UK mobile to a MSDC costs 35 pence. MSDC voting is only available from a mobile phone. It is not possible to vote by calling the MSDC from a landline or via any other method. Call charges may apply if the number is mis-dialed but isa valid number. The Promoter gives no warranty that the MSDC service will be available, legal or appropriate for use in locations outside the UK.

· Mobile In App: users of Apple mobile devices with iOS for iPhones, iPod Touch, iPads or iPad minis and users of mobile devices with Android may download the latest version of the official TheX Factor app from the relevant app store Google Play or Apple (the “app”). Download of the app is free although data charges from the user’s network operator may apply. Users ofApple mobile devices will be required to register before being able to vote and should follow the in-app prompts to do so. App users should follow the in-app prompts to vote for their chosen act(s) during the voting window. Up to a maximum of five (5) votes on each mobile device per voting window. Each account registered will allow the use of up to six (6) mobile devices. There is no charge when voting via the app although data charges from the user’s network operator may apply. Each voting window will open and close as indicated in the programme. If the vote is frozen the period before the freeze and the period after the freeze will be treated as two (2) voting windows. Any votes unused by the end of each voting window will be lost and cannot be claimed for use in the next voting window. Please note that Android users in Jersey will not be able to use the app to vote due to geographical restrictions imposed by the Google Playstore.

Entrants must seek the bill payer’s permission.

Viewers of the broadcast of the programme in the Republic of Ireland can also vote for the band they wish to see win the competition (the “IrishVote”). The Irish Vote is promoted by the broadcaster of the programme in the Republic of Ireland, Virgin Media Television, and Irish viewers may find information about voting in the Republic of Ireland on the website at www.virginmediatelevision.ie/xfactorvote.

If there are technical or other issues with the Phone, MSDC, Mobile In App or Irish votes, the Promoter reserves the right to discount the Phone,MSDC, Mobile In App or Irish votes (as applicable) and announce the result of the vote without including those affected votes.

Users of the app are limited to five (5) votes on each mobile device (up to six (6) mobile devices) per voting window. Viewers voting via Phone or MSDC or the Irish Vote may vote as many times as they like, however the Promoter believes that any votes for one (1) band which are received from any one (1) recognised number on these platforms in excess of six hundred (600) votes are deemed to be designed to excessively manipulate the outcome of the vote and are unfair to other users and other band. The Promoter and the programme producers reserve the right in their sole discretion to disqualify any votes made above the permitted levels having regard to all the circumstances and information available at the relevant time. The Promoter and/or the programme producers may in their sole discretion contact voters who have voted in excess of the permitted levels.

Voting results:

During the final of the programme, the band with the most votes will be declared the winner of the competition.

Any variation on the format of elimination as set out in these terms and conditions will be announced in the programme and such format as announced in the programme will prevail.

Contingencies

In the event of a tie in the vote results for the final of the programme, the result will be determined by the judges and their decision is final.

If one of the bands and/or contestants is unable to perform because of a technical failure, medical reasons or for any other reasons beyond the programme producer’s or the Promoter’s reasonable control that means the public vote results cannot be obtained, or the vote is cancelled, then the Promoter and the programme producers may in their sole discretion decide either to postpone the vote or cancel the vote. If the vote is cancelled, the result will be determined by the judges.

Voting method and cost:

Viewers in the UK, Isle of Man and Channel Islands may vote for which contestant(s) they wish to win the competition as specified in ‘The Voice Kids UK Series 3’ programme (the “programme”) by one of the following methods:

· Phone: Dial the premium rate‘09’ number as stated in the programme and follow instructions. You will hear a short message thanking you for your vote. Each phone vote costs 50 pence plus your network access charge. The total cost will be dependent on your network operator. Viewers can find out more information about the amount that their mobile operator will charge them by visiting http://www.accesscharge.uk/; but the Promoter and producers of the programme recommend that for the most up to date charges viewers enquire directly with their mobile network operator.

· Mobile short dial codes (“MSDC”) (also known as voice short code): UK mobile users dial the number which is the MSDC for the chosen contestant as displayed in the programme and listen to the recorded message which confirms the MSDC vote. Each vote via a UK mobile to a MSDC costs 50 pence. MSDC voting is only available from a mobile phone. It is not possible to vote by calling the MSDCs from a landline or via any other method. Call charges may apply if the number is mis-dialled but is a valid number. Voting restrictions:

While you may vote as many times as you like, the Promoter believes that any votes for one contestant, which are received from any one recognised number in excess of six hundred (600) votes, are deemed to be designed to excessively manipulate the outcome of the vote and are unfair to other users and other contestants. Therefore, if you vote for one contestant more than six hundred (600) times from any one platform, the Promoter and the programme producers reserve the right to disqualify any votes made above that number, having regard to all the circumstances and information available at the relevant time. The Promoter and/or the Programme producers may in their sole discretion contact voters who have voted in excess of the permitted levels.

Voting results:

The outcome of the vote will be shown in the programme. The four (4) finalists will perform and the contestant with the most votes will be announced the winner of the competition.

Contingencies

In the event of a tie in the public vote, the joint winners will share the prize between them.

If any of the contestant(s) are unable to perform or are prevented from performing fully in the programme for any reason including without limitation medical reasons, that contestant may at the producer's discretion be given another opportunity to perform taking into account the circumstances at the time, having regard to all circumstances and information available to them at the relevant time. The producers of the programme will in their sole discretion determine if another contestant may be allowed to enter the competition.

In the event that any of the contestant(s)withdraw from the competition either due to illness or other reasons then the programme will continue with one person less.

If illness / nerves / injury prevent any of the contestant(s) from performing in the final or interrupts their performance,that contestant may at the producer’s discretion be given another opportunity to perform taking into account the circumstances at the time. If that contestant is unable to perform, that contestant shall withdraw from the programme. If the contestant has already performed/part performed they can still be judged and voted for.

If the outcome of a vote cannot be reasonable determined because of a technical failure or for any other reasons beyond the programme producer’s or ITV’s reasonable control, the result will be announced or the vote will be run on the programme This Morning the following Monday.
