1 Acceptance of Terms and Conditions
1.1 These terms and conditions (“Terms and Conditions”) constitute an agreement between you and ITV Consumer Limited (“we” “us” and/or “ITV”) regarding goods and services offered to you through ITV Box Office (“ITV Box Office Services” or “ITV Box Office Event”).
1.2 These terms apply to our supply to you of an ITV Box Office Event by any media and on any platform whatsoever, including, without limitation via:
1.2.1 the internet at www.itvboxoffice.com (the “ITV Box Office Website”); and
1.2.2 the channels or portals on selected third party platforms, including:
18.104.22.168 Sky HD and Sky Q set top boxes (Channel 493) on Sky;
22.214.171.124 Virgin TiVo or V6 set top boxes via the live events menu on Virgin Media;
126.96.36.199 the FITE online platform; and
188.8.131.52 the Sony PlayStation 4 console (through the PlayStation Store).
(together, the “ITV Box Office Platforms”)
1.3 By proceeding to use ITV Box Office you agree to be legally bound by these Terms and Conditions. These Terms and Conditions contain important information about your rights and obligations and the restrictions that may apply when you use ITV Box Office. If you do not agree with any of these Terms and Conditions then you should not use ITV Box Office. Once you access or use ITV Box Office you will be bound by these Terms and Conditions.
2 The ITV Box Office Website
2.1 Content available on the ITV Box Office Website
The ITV Box Office Website offers users the opportunity to view television programmes, clips, graphics, logos, interfaces, layout and other audiovisual content (including any HTML tag or other code or metadata which is contained in, linked to, from and around such content) (“Content”).
Content may be made available on the ITV Box Office Website on a pay-per-view basis, an on demand basis, or a free-to-view basis. Registration may be required to access Content.
2.1.1 Pay per view basis is where you may make a one off payment to view a particular piece of Content for a defined scheduled period (as made available on the ITV Box Office Platforms from time to time) (“PPV Content”).
2.1.2 On demand basis is where you may view a particular piece of Content at a time you choose with no payment required (as made available on ITV Box Office Platforms from time to time) (“On Demand Content”).
2.1.3 Free-to-view basis is where you may view a particular live piece of Content with no payment required (as made available on ITV Box Office Platforms from time to time). Free-to-view Content may be made available on the ITV Box Office Website and/or via the ITV Box Office Platforms (“Free-to-View Content”).
To be able to view Content using the ITV Box Office Website you must have a device which is compatible with the ITV Box Office Website and an active broadband internet connection. Please see our minimum technical requirements in our FAQs at www.itv.com/itvboxofficefaqs for further information about using the ITV Box Office Website. It is your responsibility to ensure that your equipment, systems and connectivity are suitable to enable you to access the Content before you decide to make any purchase using ITV Box Office. If you are in doubt, we recommend that you check with your device manufacturer and/or your Internet Service Provider before you purchase a piece of PPV Content. We are not responsible for any costs and other charges or expenses charged by your Internet Service Provider or mobile network operator in relation to your internet service and any use in relation to ITV Box Office.
2.2 Registering to use the ITV Box Office Website
2.2.1 To view Content via the ITV Box Office Website you may be required to register (and, if the relevant Content is PPV Content, to complete a purchase of that Content). To be eligible to register you must be:
184.108.40.206 18 years old or over. If you are under 18 you must have a parent or guardian’s permission to use ITV Box Office and your parent or guardian should be the one to register or pay for content;
220.127.116.11 located in the United Kingdom, Channel Islands or Isle of Man (“the Territory’); and
18.104.22.168 a natural person (i.e. not a company or other business entity).
2.2.2 If you do not meet the above criteria you should not access or use the ITV Box Office Website. You agree that you will provide us with proof of your identity if reasonably requested by us to do so from time to time.
2.2.3 Upon registration you will be required to provide information including (but not limited to) your email address, and you will need to choose a valid password.
2.2.4 To purchase PPV Content following registration you will be required to provide your payment details (including your address, your Sky VCN number and your credit/debit card or paypal details) and follow the instructions provided on the ITV Box Office Website.
2.2.5 Your password is secret and confidential to you and you are responsible for keeping it secure. If you know or suspect your password has been compromised please change your password by clicking “Forgotten Password” and following the link provided in the email we will send to you. We will never ask you for your password in an email or when calling you by telephone. We will never invite you to log in to your account through a link in any email communication you receive from us.
3. The ITV Box Office Platforms
3.1 An ITV Box Office Event can be accessed in four different ways via the ITV Box Office Platforms, via:
i. Sky \(only available to Sky HD or Sky Q set top box customers\) ii. Virgin Media \(only available to Virgin Media TiVo and V6 customers\) iii. FITE; or iv. Sony PlayStation 4 consoles \(through the PlayStation Store\).
3.1.1 If you are a Sky customer, you can access an ITV Box Office Event on your Sky HD or Sky Q Set Top Box by going to the ITV Box Office Website, and when prompted selecting the “Watch on Sky” option. The ITV Box Office Website will ask you to enter your username and password details. If you have previously purchased an event through the ITV Box Office Website and you have consented to ITV storing your payment details for the purpose of enabling you to buy events via your Sky remote control, then you can buy using your Sky remote control on your Sky set top box. ITV Box Office Events go on sale via the Sky set top box 7 days in advance. If you are not already registered with ITV Box Office, you can register and complete your purchase on the ITV Box Office Website. Once you have completed your purchase, we will authenticate your viewing card to view the event you have purchased. The ITV Box Office Event channel on Sky is channel 493. Please note, all of the terms and conditions which apply to your use of Sky’s services apply in relation to your access to an ITV Box Office Event when using the Sky platform;
3.1.2 If you are a Virgin Media customer with a TiVo or V6 Set Top Box, you can access the ITV Box Office Event on your Virgin Media TiVo or V6 Set Top Box by going to the Live Events menu and selecting the relevant event. When you purchase the ITV Box Office Event via Virgin Media, you are contracting with Virgin Media (and not ITV) and any terms and conditions which you enter into with Virgin Media apply. If you have any difficulties accessing the ITV Box Office Event via Virgin Media, please contact Virgin Media (see help.virginmedia.com for details).
3.1.3 If you want to watch the ITV Box Office Event online, you can buy the event from FITE at www.fite.tv. When you purchase the ITV Box Office Event from FITE, you are contracting with FITE (and not ITV) and any terms and conditions which you enter into with FITE apply. If you have any difficulties accessing the ITV Box Office Event via FITE, please contact FITE (see https://support.fite.tv/hc/en-us for details).
3.1.4 If you are a PlayStation Video customer you can access the ITV Box Office Event on your PlayStation 4 console only. When you purchase an ITV Box Office Event from PlayStation Video, you are contracting with PlayStation Video (and not ITV) and any terms and conditions which you enter into with PlayStation Video apply. 4 Billing and payment (this section does not apply if you are purchasing via Virgin Media, FITE, or PlayStation Video, please check your Virgin Media Terms and Conditions, your FITE Terms and Conditions or your PlayStation Video Terms and Conditions for details)
4.1 The price of any PPV Content will be as stated on the ITV Box Office Website. All prices include VAT, where applicable, and any other applicable taxes.
4.2 All prices quoted on the ITV Box Office Service constitute an offer of services and only when we send you email confirmation will your purchase be final. At that point a binding contract will exist between us and you for the provision of the Content which you have purchased.
4.3 If you purchase any PPV Content from us you may cancel your purchase and receive a full refund at any time up to the earlier of (a) 14 days after the date on which we sent you email confirmation of your purchase, or (b) the time at which we make available the PPV Content purchased to you, at which time the provision of the services which have purchased has commenced and accordingly you will not have a right to cancel your purchase. If you wish to cancel, please call Customer Support on 0330 123 9533 or email us at firstname.lastname@example.org. Refunds will only be processed to the payment method used for the initial purchase. Please note that email requests may take up to 5 working days to be processed and so if you require immediate assistance please call Customer Support. You may use the model cancellation form appended to these terms, but it is not obligatory.
4.4 Purchases of PPV Content can be made by credit or debit card or via PayPal as indicated on the Website.
4.5 By entering credit/debit card details you are confirming that you are the owner of the credit/debit card (i.e. that the card was issued in your name) or that you are authorised by the owner of the credit/debit card to make the purchase.
4.6 All personal or payment details sent over the internet will be securely encrypted using SSL technology. All card transactions conducted using the ITV Box Office Website are processed using secure technology which complies with the PCI DSS Level 1 compliance standard.
5 Content available on ITV Box Office
5.1 We reserve the right to remove and/or alter the Content available via ITV Box Office and/or the functionality of the ITV Box Office Website at any time and for any reason whatsoever.
5.2 We will make reasonable efforts to keep the ITV Box Office Website operational at all times, however we cannot guarantee that your use of the ITV Box Office Website will be uninterrupted or error-free. From time to time we may temporarily suspend or remove the ITV Box Office Website for technical, maintenance or operational reasons.
6 Security Technology
6.1 We use security and security technology for the ITV Box Office Website to protect the material and content made available and content made available on the ITV Box Office Website. You must not penetrate, remove or otherwise alter or interfere with any security measures used in connection with the ITV Box Office Website, or attempt to do any of those things or assist any other person in doing or attempting to do any of those things.
7.1 The ITV Box Office Website uses “geo-blocking” measures to prevent you from accessing the services from outside the Territory. This is necessary for us to comply with the terms of our broadcast and content licences. You agree not to attempt to access, and/or not to attempt to circumvent the geo-blocking measures to access the ITV Box Office Website from outside the Territory. If you do so we reserve the right to remove your entitlement to view any PPV Content you may have purchased via the ITV Box Office Website.
8 General restrictions
8.1 You agree that you will comply with our reasonable instructions regarding your use of ITV Box Office. You agree that you will not (and you will not allow any other person to) use ITV Box Office for any purpose which is commercial, unlawful or otherwise improper. In particular, except as expressly permitted by these Terms and Conditions or otherwise by us, you will not by any means as a result of or in connection with your use ITV Box Office to:
8.1.1 remove, alter, bypass, avoid, interfere with or circumvent the security software or (if applicable) any geo-blocking software;
8.1.2 copy, download, lend, hire, broadcast, stream, capture, reproduce, archive, share, distribute, modify, translate, display, transmit or make the Content available to the public;
8.1.3 remove or alter any copyright or other proprietary notice from the ITV Box Office Website, the ITV Box Office Services, any of the ITV Box Office Platforms or from any PPV Content;
8.1.4 extract any data or metadata from the ITV Box Office Website, the ITV Box Office Services, any of the ITV Box Office Platforms or any Content nor create any index or database incorporating any Content or any part of it;
8.1.5 block, disable, obscure or impair any advertising or sponsorship on the ITV Box Office Website, the ITV Box Office Services, any of the ITV Box Office Platforms or associated with any Content;
8.1.6 capture or store any personal information relating to other users of ITV Box Office;
8.1.7 incorporate ITV Box Office into another service or website or make it available via frames;
8.1.8 reverse engineer, de-compile, disassemble, alter, duplicate, modify, rent, lease, loan, sub-license, make copies, create derivative works from, distribute or provide others with ITV Box Office or any Content;
8.1.9 create any works or materials derived from or based on any Content or ITV Box Office;
8.1.10 use ITV Box Office in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person; or
8.1.11 do anything that may cause damage to ITV Box Office or our servers, systems or equipment or those of third parties, nor access or attempt to access any users' data or to penetrate or attempt to penetrate the ITV Box Office Website security measures.
8.2 You agree to compensate us in respect of any damages suffered by us or any of our losses resulting from any claim made by a third party in each case in respect of any matter arising from your use of ITV Box Office in breach of these Terms and Conditions or from your violation of any applicable law or regulation.
8.3 You agree not to give any indication that you have any commercial relationship with us, or that you are our agent or that we have endorsed any submission you may make.
8.4 We reserve the right to suspend, restrict or terminate your access to ITV Box Office at any time at our sole discretion. We may also ban or suspend you as a user of ITV Box Office if you do not comply with these Terms and Conditions.
9 Trademarks and copyright
9.1 All intellectual property rights in ITV Box Office and all content made available via ITV Box Office shall remain at all times the property of ITV or ITV’s licensors. The names, images and logos identifying us, companies in the ITV group, our partners or third parties and our/their products and services contained within ITV Box Office are proprietary marks and may not be reproduced or otherwise used with express permission. Nothing in these Terms and Conditions shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright of ITV or of any third party. You do not acquire any ownership right in any Content by accessing the Content on ITV Box Office.
10 Advertising and third party sites
10.1 The ITV Box Office Website may contain links (whether by way of an advertisement or otherwise) to other third party sites and services. Such links are provided for your ease of reference and convenience only. We have no control over those third party sites or services and are not responsible for their contents. We do not endorse the material contained in any third party’s sites or services and have no association with their operators. You agree that we will not be a party to any transaction or contract with a third party that you may into enter into and we will not be liable to you for any loss or damage which you may suffer by using those third party sites and services. You agree that you will not involve us in any dispute you may have with such third party sites and services.
11 Limitation of Liability
11.1 All services are provided on an ‘as is’ and ‘as available’ basis. We cannot promise that ITV Box Office will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition, or free from viruses or other harmful components. Not all of the features and functionality of the ITV Box Office Website will work on all devices. We make no guarantee that all or any features of the ITV Box Office Website will work on any particular device. Whilst we do take reasonable precautions to prevent the occurrence of computer viruses and/or other malicious programmes, we accept no liability for them.
11.2 These Terms and Conditions shall not make us responsible for any damage or loss caused to you where such damage or loss is not reasonably foreseeable to you and us when you use ITV Box Office, including where the damage or loss results from our breach of these Terms and Conditions.
11.3 ITV Box Office may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our reasonable control. Except as set out elsewhere in these Terms and Conditions we will not be liable to you or to any other person in the event that all or part of ITV Box Office is unavailable, discontinued, modified or changed in any way.
11.4 We do not accept any liability for:
11.4.1 any damage or loss caused to you where you are not entering into these Terms and Conditions as a consumer;
11.4.2 any damage to your computer, any software or for any loss of data that results from your use of ITV Box Office;
11.4.3 any failure, any suspension and/or any termination of access to the ITV Box Office or any content in connection with or arising out of a force majeure event. In these Terms and Conditions, a "force majeure" event shall include, without limitation, strikes, lock-outs or other industrial disputes, nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage, compliance with any law or government order, rule regulation or direction, accident or breakdown of plant or machinery, fire, flood, storm or default of suppliers, and where they are beyond our reasonable control, any other acts, events, omissions or accidents; and/or
11.4.4 any claims brought against you by a third party except as stated in these Terms and Conditions.
11.5 Nothing in these Terms and Conditions will:
11.5.1 restrict your statutory rights as a consumer (including your rights to receive a reasonable standard of service, more details about which can be obtained from your local Trading Standards Office or Citizen's Advice Bureau); or
11.5.2 limit our liability for death or personal injury resulting from our negligence or for fraud.
12 Other important terms
12.1 If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions which shall remain in full force and effect.
12.2 These Terms and Conditions are available in English only and shall be governed by and construed in accordance with the laws of England (or the laws of Scotland or Northern Ireland if you are domiciled there). Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales unless you choose the jurisdiction of your domicile in Scotland or Northern Ireland.
12.3 These Terms and Conditions were last updated on 20 February 2019. Please note that we may update and amend these Terms and Conditions from time to time and any changes will be posted on the ITV Box Office Website and may also be notified to you by email (if you are a registered user of ITV Box Office and have provided us with your email address). By proceeding to use ITV Box Office you agree to be bound by any changes to these Terms and Conditions. However, it is your responsibility to ensure you review these Terms and Conditions regularly to familiarise yourself with any changes. We will not file or store a copy of these terms for each interaction on transaction by you via ITV Box Office. We therefore recommend that you print and store or save a copy of these Terms and Conditions for future reference.
